本論では、ベトナムにおける裁判外紛争処理制度(ADR、Alternative Dispute Resolution)である和解組(To Hoa Giai)による調停の基盤となる、公的言説としての モラリティについて考える。和解組の実践を支えているのは、国家、地方行政、一般 住民のあいだで共有される訴訟忌避規範、内済規範、あるいは、むらのなかでの騒擾を罪悪視する規範である。公的領域においては、国家や宗教的権威に代表される制度 的モラリティがストレートに統制力を発揮することは希である。それとともに、日常的な生活態度に埋め込まれたモラリティも、多くの場合、独力では公共的な表現のかたちをもつことができない。そのようなとき、日常的な生活態度に埋め込まれたモラ リティは、制度的モラリティを仮借することによって、公的領域での討議にも耐えう る体系的なモラリティであるかのような体裁で語られる場合がある。本論では、こういったモラリティの生成を制度的モラリティと公的言説としてのモラリティの相互交 渉がもたらす効果として考える。その際、本論では東アジア的脈絡においてこの問題にアプローチした先駆的なモデルとして「生ける法」(末弘嚴太郎)と「通俗道徳」(安丸良夫)のアイデアを援用しながら制度的モラリティと公的言説としてのモラリティ の相互交渉の局面についての分析枠組みを提示する。そのうえで、ベトナムの村落での紛争処理に際して実施される「集団」(tap the)に対する謝罪という慣行の分析を通 して、このモデルの有効性を検証していく。This essay examines the moral basis of the Reconciliation Service (To Hoa Giai ), the community mediation system in Vietnam. The system is supported by the norms of litigation avoidance and private settlement, as well as norms that regard creating disturbances in a village community as a public offence, which are widely shared throughout the state and local cadres and among ordinary people. In the "public" realm of reconciliation, institutional morality of the state or religious organizations seldom provides straightforward guidance, while it is also difficult for the embodied morality of everyday practice to govern such matters independently. Usually, people borrow from the vocabularies of institutional morality to express their morality of everyday life, implying that this system of norms can withstand scrutiny in public debates. Drawing on the ideas of "living law" (Izutaro Suehiro) and "popularized morality" (Yoshio Yasumaru) as pioneering works that approach these issues in the East Asian context, this essay describes these norms as morality in public discourse ̶ the effects of dialogues between institutional morality and embodied morality, . This essay also analyzes the custom of apologizing to the "collective" (tap the ) in the process of reconciliation in a Vietnamese village to demonstrate the above analytical framework.
