出生前診断によって胎児に先天性異常が指摘された場合, 妊娠の継続をめぐり, 「胎児の生命」 と 「女性の出産に関する自己決定」 という2つの価値が両立せずに衝突する可能性が示唆される. 本稿では先ず, 「胎児の生命の保護」 を法益として定めている刑法と, 人工妊娠中絶の根拠となる母体保護法および旧優生保護法について確認を行う. また, 出生前診断について医療側に過失があり, 結果的に障害を有する児が生まれたケースにおいて, 裁判所がどのように患者側の損害や因果関係の認定を行ったのかという視角から, 出生前診断が 「胎児の生命」 や 「出産に関する自己決定」 に及ぼす影響や意味について検討を行う.

A questionnaire survey was conducted on citizens taking medication for chronic diseases (type 2 diabetes, hypertension, asthma, atopic dermatitis). As a result, 52.7% had residual drugs. Patients who use GPs or pharmacies tend to self-stockpile drugs in preparation for a disaster. These patients may have previously been informed about the need of self-stockpiling drugs in case of emergency. Those who responded that they were at risk of a secondary disaster tended to self-stockpile drugs in preparation for long-term evacuation. Although the risk of self-stockpiling of drugs by patients with chronic illness may not be high, it is desirable for pharmacies to be more actively involved to ensure safe self-stockpiling.

This study is a survey targeting psychotropic medication recipients. We investigated the consciousness concerning stockpiles of psychotropic drugs for disasters. More than half of the respondents had extra psychotropic medicine, and 30.5% of the respondents were stockpiling in preparation for the disaster. Existence of family pharmacies and the existence of disaster risks around them were factors related to stockpiling behavior. However, it is suggested that stockpiling of psychotropic drugs may be carried out by citizen's own judgment. Inappropriate use of psychotropic medicine at evacuation centers may cause health problems and extra medical expenses, so medical staff must instruct them. There are many needs of psychotropic drugs from citizens in disasters. However, it is financially difficult to stock up drugs for disaster at hospitals. It is desirable to set up a public disaster storage warehouse near the evacuation center.
