本稿では,イギリスにおける特別な教育的ニーズをめぐるオンブズマン提訴事例を取り上げ,その特徴と,親の権利保障の実情を把握することを目的とした。今回,この事例を取り上げたのは,1事例の中で複数の不服申し立てがなされ,各々について,オンブズマンの裁決の基準となる「過誤行政」と「不公平」に関して,異なる判断が示されており,特別な教育的二一ズをめぐる親の権利が実質的にどのような意味を持ち合わせているのを検討するのに適していると考えたからである。本事例における主要な論争点は,子どもの特別な教育的ニーズの評価の段階において,当局が,①子どもの状態について適切な情報を獲得せず,②親に情報を提供するのを怠り,③判定書を作成するかどうかの決定に長時間を要したという点,及び,判定書の作成の前後において,④正規の当局の職月でない者が報告書を作成し,⑤その作成者と報告書について議論するように手配せず,⑥作業療法士の報告を受けず,⑦分子どもに対して別の教育の場を検討しなかった,という点であった。結果は,評価の段階における①~③については,「過誤行政」の結果として「不公平」を親が被った点を認め,当局に賠償の支払を命じた。しかしながら,判定書の作成の段階においては,④,⑤, ⑦については「過誤行政」は認められず,また,⑥については,「過誤行政」は認められたが,それによって「不公平」が生じたとは判断されなかった。今回の事例より,特別な教育的ニーズをめぐるオンブズマン提訴事例においては,手続き上の不備や時間的な遅延の場合に,親の不服申し立てが認められ可能性が強いが,教育の場の決定に直接関わる段階になると,当局の裁量が支持される傾向にあることが示唆された。その一方で,オンブズマンは,教育法令には規定されていない不服申し立て事項を補完する機能を有していることも明らかにされた。The purpose of this study was to analyze the case of the ombudsman concerning special educational needs. In this case parents lodged some complaints which were as follows; 1 ) During the assessment the Council failed to obtain adequate information about their daugher's condition. 2 ) It failed to keep them fully information. 3 ) It took too long time in deciding whether a formal statement should be issued. 4 ) It accepted a report from an officer who was not employed. 5 ) It failed to arrange for them to discuss the report. 6 ) It failed to obtain an occupational therapist's report. 7 ) It failed to consider alternative placements for their daugher. For the complaints of 1), 2), and 3), maladministration leading to injustice was accepted and the ombudsman recommended that the injustice should be remedied. For the complaint of 6) maladministarion was found but injustice wasn't accepted. For the rest of complaints maladministraion wasn't found. From this case study it was suggested that ombudsman would complement the appeal systems which were based on the educational law.
