黒坂愛衣『ハンセン病家族たちの物語』(世織書房,2015)の出版がひとつの大きな梃子となって,2016年2月に熊本地裁に対して「ハンセン病家族集団訴訟」が提訴された。そして,2016年12月26日の第2回弁論のときに「原告番号188番」の女性が意見陳述をした。「私は,昭和33年8月4日,宮古島にあるハンセン病療養所,宮古南静園で生まれました。(中略)実は,母は,私を妊娠していることが分かり,南静園の職員に堕胎させるための注射をうたれたのですが,その注射が失敗したおかげで,私は生まれることができました。」その瞬間,この話,私たちは聞いたことがあると思った。宮古南静園からの退所者,知念正勝氏からの聞き取りでだ。知念氏からの聞き取りは,2008年2月19日,宮古南静園の面会人宿泊所「南楓荘」にて実施している(本誌本号に「隔離政策と優生政策と――あるハンセン病療養所退所者の聞き取り」と題して収録)。この女性原告は,知念正勝氏の娘さん,Mさんであった。私たちは2017年5月4日~7日の日程で,原告団副団長の黄光男(ファン・グァンナム)氏を誘って宮古島へ。5月4日午後には園内フィールドワーク,夜は,宮古の家族原告の会「ティダの会」のみなさん,退所者,入所者のみなさんに集まってもらって懇親会(総勢25人)。翌日,ご自宅にてMさんから聞き取り。「ハンセン病家族集団訴訟」における被告国の主張は"政府の隔離政策は,患者を対象としたもので,家族までも対象とするものではなかった。国の政策の被害が家族にまで及んだとは認められない"というものだ。国の代理人は,本気でそう考えているのだろうか。妊娠中に両親がハンセン病療養所から脱走することで命が守られ,いま,この裁判の原告となっている人と,私たちは何人も出会っている。そして,Mさんは,療養所内で妊娠中の母親が堕胎のための注射を打たれたが,幸いにも注射がはずれたために,命を拾った人だ。あきらかに国は"終生隔離絶滅政策"のなかで,患者たちのみならず,その子孫の抹殺をも企図していたのだ。ただ,それが完璧には遂行しえなかっただけなのだ。――とは言いつつも,その背後には,膨大な数の,堕胎によって抹殺された嬰児の命がある。今回の家族訴訟でも"自分のきょうだいが堕胎された"と語る原告が何人もいる。The publication of Ai Kurosaka's Japanese original version (Seori Shobo, 2015) of Fighting Prejudice in Japan: The Families of Hansen's Disease Patients Speak Out (Melbourne: Trans Pacific Press, 2018) functioned as the leverage for the lawsuit of class action of Hansen's disease patients' families at Kumamoto District Court in February 2016.In December 26th, 2016, at the second pleading of the trial, a female plaintiff whose number is 188 stated her opinion as follows."I was born in National Sanatorium Miyako Nanseien at Miyakojima Island in August 4th, 1958. To tell the truth, my mother was forced to get the abortion injection by the staff of the sanatorium when she was pregnant with me, but fortunately the injection did not work and I was able to be born to my mother."When we heard her statement, we immediately reminded that we are already familiar with this story from the interview with Mr. Masakatsu Chinen who once lived in Miyako Nanseien. The interview with Mr. Chinen was practiced at Nanpu Hall, the visitors' lodge of Miyako Nanseien in February 19th, 2008. (This interview is published with the title of "Segregation Policy and Eugenic Policy: An interview with a Former Resident of a Hansen's Disease Sanatorium" on the same issue of this journal as well.)This female plaintiff is surely Mr. Chinen's daughter. (We call her Ms. M in this paper.) We visited Miyakojima Island with Mr. Gwangnam Hwang, the vice representative of the plaintiffs group during May 4th and 7th, 2017. On May 4th we spent afternoon time to practice the field work in the sanatorium, and had a convivial gathering with the members of Tida-no-Kai (Society of Sun), that is, the group of the plaintiffs in Miyakojima, and former and current residents of the sanatorium (25 people in total). On the next day, we held an interview with Ms. M at her place.The government of Japan, the defendant of the lawsuit stated that the Segregation Policy only targeted Hansen's disease patients themselves, thus they would not accept the claim that this policy negatively affected the patients' family lives. I wonder if the legal representatives of the government honestly agree with this statement or not. We have met several plaintiffs who could live thanks to the fact that their parents ran away from the sanatorium while they were in pregnancy. Even Ms. M is the survivor from the abortion injection that the sanatorium staff forcedly gave to her pregnant mother. Certainly, the government attempted to annihilate not only Hansen's disease patients but also their descendants through the Segregation and Extermination Policy and they just failed to achieve it perfectly. However, we should not forget there had been enormous unborn lives due to this policy. In the lawsuit of class action of Hansen's disease patients' families, many plaintiffs say that their unborn brothers and sisters were aborted by the government policy.
