The penal regulations which impose legal controls and inflict punishments on speech and writing should be presumed unconstitutional. In order that the provisions on sedition of the Anti-Subversive ActivitiesAct may be taken constitutional, the following requirements should be satisfied. (1) It should not be permitted to punish the accused by reason of mere seditial action. (2) It should be recognized that the critical conditions of actual harm may come into being concretely.
