The Prime Minister Shinzo Abe Administration advocates“break away from the postwar regime”. As a part of measures crystallizing his idea,the government party occupying an absolute majority of the Diet forced to amend the fundamental law of education completely,and enforced the new fundamental law of education,on December 22,2006. The original law was made in 1947,based on the educational philosophy and principles which profoundly criticized and denied the prewar educational system under the imperial rescript on education. In addition,the government party passed three education- related bills(school education law,teacher license law,organization and management of the local educational administration). What is the true purpose of successive amendments on educational laws? What kind of problems in terms of educational science do they have? This paper examines the new fundamental law of education carefully,and,pointing out the problems of the law,clarifies the real figure of“break away from the postwar regime”in the field of education. This paper also proposes some viewpoints to overcome the problems.
