The Prime Minister Shinzo Abe Administration advocates“break away from the postwar regime”. As a part of measures crystallizing his idea,the government party occupying an absolute majority of the Diet forced to amend the fundamental law of education completely,and enforced the new fundamental law of education,on December 22,2006. The original law was made in 1947,based on the educational philosophy and principles which profoundly criticized and denied the prewar educational system under the imperial rescript on education. In addition,the government party passed three education- related bills(school education law,teacher license law,organization and management of the local educational administration). What is the true purpose of successive amendments on educational laws? What kind of problems in terms of educational science do they have? This paper examines the new fundamental law of education carefully,and,pointing out the problems of the law,clarifies the real figure of“break away from the postwar regime”in the field of education. This paper also proposes some viewpoints to overcome the problems.

私は過去20年余り,アメリカの教育行政学や教育経営学を主たる専門研究領域としてとしてきた。しかし,その研究の視点は徐々に変化しつつあり,近年では,教育制度や教育行政の理論研究から,それを規定する風土的考察に移りつつある。それは,敢えて言うならば,日本とアメリカの教育行政の制度と思想の比較風土的考察ともいうものである。ところで近年,イダヤ・ベンダサン著『ユダヤ人と日本人』に刺激されて,『日暮硯』に取り組む機会を得た。『日暮硯』の思想は,私にとって衝撃的かつ教訓的であった。その結果として私は,『日暮硯』の思想は日本的政治=経営思想の原点ともいうべきものであること,また同書は日本における学校経営学及び教育行政学のもっとも優れたテキストになるのではないかと考えるに至った。本研究は『日暮硯』に学ぶ学校経営学-日本的学校経営の真髄-」の第II報である。本稿では,『日暮硯』に記録されている権力主義の政治=経営の事例に焦点をあて,その事例から学校経営は何を学ぶべきかを考察していく。This paper is intended as an investigation of the characterstics of school management in Japan. "Higurasi-Suzuri" is the classical book which was written by Baba Masakata in the Edo Era. It is the book about Moku Onda's administration and management in Matsushiro country who was the one of the bureaucrats of budget at the time. This is the second paper on "Higurasi-Suzuri". In this paper, I focused on the administration and management of Hachirogoro Hara and Mr. Hannemon Tamura in Matsushiro country. Since the characterstics of their administration and management were autocratic and heartless, people offered stubborn resistance to their government. What should school principals and school administrators learn from above government? I try to present some rules of school administration and management for today.
