研究ノート(Note)「ガザの自由」船団事件を契機に、封鎖法は様々な国内、国際機関からの評価を受けた。そこで、本稿では事件を手がかりに海上封鎖を分析し、その慣習法規則のあり方を明らかにすることを目的とする。封鎖法の検討では、中立国通商保護の要請から生じた伝統的要件に加え、第二次世界大戦後の人道規則の発展により生じた人道的要件を確認した。そして、「ガザの自由」船団事件におけるこれらの要件の評価を検討することで、今日の封鎖において適用される慣習法規則を確認した。After the Gaza flotilla incident, blockade law is analyzed by various institutions. Hence, this article will reveal the modern customary blockade law based on these reviews. In considering, I retraced the development of traditional requirements derived from protection of neutral benefits and humanitarian requirements affected according to the progress of humanitarian law after the WW2. Then, I confirmed modern customary rules of blockade through the analysis of the Gaza flotilla incident.
