研究ノート(Note)中国における裁判独立は、中国の特色がある。それは、裁判所と中国人民代表大会(その常務委員会)、政府、上級裁判所、共産党及び社会世論との外部関係に反映されている。また、裁判所内部における裁判官と院長・副院長・庭長、裁判委員会との内部関係は中国の裁判独立にある程度の影響を及ばしている。本稿は、2009年中国最高裁判所が公表した「裁判所改革網要」をめぐって、中国における裁判独立と判決書に関する改革を検討するものである。The judicial independence of china has its own characteristics. These characteristics are expressed by the relationship between the courts and the people's congress, the courts and the government, etc. And the judicial independence is partly influenced by the relationship among the interior of courts, such as the relationship between judges and the chief judge, judges and the court adjudication committees. The Supreme People's Court of China issued the "Third Five Year Reform Program for the People's Courts (2009-2013)" in 2009. The article examined the reforms of the indicial independence and judgment around the Reform Program.
