本稿では,著作権法を中心にデジタル・ネットワーク化によって生起した知的財産権問題の現状認識と課題の抽出を行い,経済財としての「情報」の「価値」について考察を行う.そののち,現行著作権法が著作権を複製権等の支分権の集合体として構成しているのに対し,デジタル・ネットワーク化環境に著作物がデジタル化されて置かれたときは,「著作物の本饗的価植が享有されたときに著作権者の権利が働く」とする知的財産権法の可能性について論じる.さらには,創作性の有無にかかわらず「情報一般」の保護のあり方について考察する.

ゲームソフト等のデジタルコンテンツは、その商品が中古になっても情報が劣化しないので中古販売を認めることは、権利者の利益を著しく損なうとしばしは主張されることがある。しかし、デジタルコンテンツの情報のビットストリームは、中古になっても保持されるが、その情報の価値は、時間の経過とともに劣化する。情報の価値が利用者に享受されたとき、当該情報の権利者の権利が働くとする知的財産権法制の構築を考えたとき、そのままでは、権利者の権利保護に厚い法制となる。権利者の権利保護と利用者の自由な利用のバランスの観点から、本稿では,情報の価値は一般には、時間の経過とともに劣化することに着目し、価値の劣化とともに権利者の権利も消尽する考え方を提案する.It is frequently insisted that interest of the right holders will be injured extremely by business of selling used content because digital content dose not lose its quality even though it become used. It is true that bits stream of digital content will keep its bits pattern permanently, however, the value of the digital contents may deteriorate with the passing time. Construction of intellectual property law system under which the rights to copyright holders of content can be enforced when essential value of such content is enjoyed by user, might lead results which are too much favorable to right holders. From the point of view of balance between protection of right holders and free use by users, I would like to propose that rights of right holders should be exhausted with deterioration of the value of content.
