1世紀以上前に作られた現行著作権法の仕組みは,1)著作物・著作権に関する網羅的なデータ制度がないこと,2)利用禁止がデフォルトのルールであること,の2点において,デジタル・ネットワークを用いた情報流通の障壁となりやすい側面を持っている。クリエイティブ・コモンズ・ライセンスは,メタデータと著作権法に基づくライセンス条項を組み合わせることで,権利者にまつわる情報を提供しつつ,事前に許諾を与える範囲を明確化し,これらの問題点を解決しようとする私的な試みである。現在約40カ国で採用され,4000万以上のコンテンツに採用されているクリエイティブ・コモンズを紹介し,将来の展望について概観する。The framework of the current copyright law creates problems in the information flow in the digital network era in a sense that: i) it does not provide thorough data system regarding information of copyrights or authors; and ii) the default rule of the law is to prohibit any use of copyrighted materials. Creative Commons is a private effort to solve these problems by combining legal license and metadata system, thereby providing information regarding copyrights and/or authors and making clear that certain licenses are granted beforehand. This article is to introduce the basics of Creative Commons that are adopted in almost 40 countries worldwide, and set out some future visions.
