Inpatients in mental hospitals human rights have been infringed upon even after "The Mental Health & Welfare Act" was amended. I think that the factors associated with this could be "the specificities in the mental hospitals", which have a background influenced by the "Mental/Medical Policy" Therefore, the "Mental/Medical Policy" needs to be changed in order to prevent infringements on patient's human rights in mental hospitals, and I would like to suggest a remedy for this problem.

我が国における精神障害者に関する法制度の変遷をたどり、精神障害者が歴史的にどのように処遇されてきたかを明らかにする。精神障害者処遇の法制度は1900年に制定された精神病者監護法にはじまり、現在は精神保健及び精神障害者福祉に関する法律に至っている。その間、精神衛生法、精神保健法と名称も変化した。その変化は、精神障害者処遇の歴史でもある。この研究では、文献から法改正の背景と改正による患者処遇の変化、そして、その問題点を明らかにする。
