本稿は、2011年7月に改正された障害者基本法において、「発達障害」が「障害者」の定義をめぐる議論において、どのように取り扱われたかを検討した。今回の改正は、2009年12月から開始された「障がい者制度改革」の一環として取り組まれたものであった。「制度の谷間」を生まない「障害者」の定義のあり方は、「制度改革」の主要な論点の一つでもあり、その前提ともいうべきものであった。しかしながら、改正案における「障害者」の定義は、従来の3障害に「その他の心身の機能の障害」を追加したものに過ぎなかった。さらに、当初「その他」に含むとされていた発達障害は、「『精神障害』に含む」とする変更がなされたが、このようないともたやすい変更は、「発達障害」のおかれた「位置づけ」の弱さを物語るものであった。2012年7月、「制度改革」は一応の終結をみたが、「Nothing about us without us !」のスローガンに象徴された「当事者主体」の理念は、今後の政策に引き継がれていくべきものであった。

本稿は、2010年初頭から開始された「障がい者制度改革」において、障害者権利条約第24条の求める「インクルーシブ教育システム」について、どのような議論がなされたのか検討することを目的とした。「障がい者制度改革推進会議」における、「インクルーシブ教育システム」に対する評価には、現状からの変更を伴う事項を中心に、構成員による違いがみられた。また、「第一次意見」のとりまとめがなされる段階には、インクルーシブ教育システムについて、「押し戻し」の様相が強くなっていた。

2016年5月に改正された発達障害者支援法を対象に、改正の経緯ならびに改正法にみられた特徴を検討した。改正法案は、日本自閉症協会の要望をきっかけとして、発達障害の支援を考える議員連盟を中心に検討されたものであった。改正法にみられた特徴としては、新設・追加された条項が多数にのぼったこと、障害者基本法や障害者総合支援法との「整合」が強く意識されたものであったこと、発達障害の「特性」など、障害の固有性やその支援における独自性がより強調されるようになったこと、などがみられた。今後の課題としては、国際疾病分類の改定に対応した、発達障害の範囲や定義についての検討が必要なことであった。

The facilities for children with autism are the only welfare service peculiar to persons with autism in our country. This research aimed to clarify the development of the welfare for persons with autism by analyzing process of installation and institutionalization of the facilities for children with autism. At first, the facilities for children with autism were set up as facilities specific to autism in 1969. Later, it was reexamined what the facilities for children with autism should be like on ground of various problems in management of the facilities for children with autism. The discussion to emphasize "Realistic countermeasure" which is that an intellectual handicaps accompanied autism was performed there. Thus, the facilities for children with autism were turned over in legal facilities, and assumed to be a kind of the facilities for children with intellectual handicaps. The principle of the treatment in the intellectual handicaps frame to persons with autism which ran here now established.
