The Borloo Law enacted in France in 2003 defined the guidelines for improvement projects as well as the maintenance management system for the regeneration of the housing estate including the role of associations involved in the process. This paper clarifies the significance and the role of the associations. In case of Angers city, the association “Régie de quartier d’Angers” was engaged as an association to represent inhabitants. It knew the local circumstances and went in the deliberation from earlier phase of the project and also took the responsibility for maintenance management. The proceeding reflects the regards of the inhabitants. The system of vegetable garden that was introduced enhances the community-building and the public safety measures, it is in the interest of ecological education, and finally contributes to more employment. It is argued that the maintenance management by the associations achieves the purpose of the Law, which aims towards sustainable reforms of habitation and dwelling environment.

近年、日本では、地方分権を背景として、地域の実情に即して、資源、人材や組織を活かしながら観光政策や都市マネジメントを推進していくことが重要になってきている。とりわけ、基礎自治体を重視した公共団体間の役割分担の明確化や、公共団体と民間主体が協調し、民間が力を発揮できるために、各主体の法制度上の位置づけが課題とされている。一方、フランスでは、1980年代以降の地方分権改革に伴い、制度・機構改革が行われてきており、これまで地域振興や観光政策を担ってきた非営利団体等やその活動を、基礎自治体が公認する「公定化」の仕組みが制度上整えられてきている。そこで、本研究では、フランスの観光政策の主体に着目し、観光政策にかかわる法制と政策主体の活動実態を「地方分権」「公定化」という観点から考察することで、各主体の役割や制度上の位置づけを明らかにし、都市マネジメント主体のあり方を示唆する。
1 0 0 0 OA 都市マネジメント主体の変化と実態:フランスの住民参加手続・公定化手続に着目して
本研究では、日本の各地域に対応した都市マネジメントにおける「主体」に関する課題を再確認した上で、地方分権改革や、都市計画法等の制度改革を進めるフランスを素材として調査、検討を行った。その結果、本研究では、フランスにおいて、住民や利用者など多様な関係者の意向を民主的な手続により聴取し、反映する手続(参加手続)と、多様な主体が都市マネジメントの担い手として活躍するための手続(公定化手続)を、法令制度として創設している実態を明らかにし、これらの具体的な仕組みと運用方策を地域類型に応じて提示した。
