The purpose of this essay is to propose a renewed concept of civilization more suited to the twenty-first century that followed the one remembered for plunder, exploitation, and the destruction and sins of war. By way of illustration, Samuel P. Huntington's The Clash of Civilizations is reviewed and analyzed in the light of the proposed concept of civilization. The much criticized book, for all its insight, is characterized by its insidious attachment to the residua of the "modern." The human society now desperately needs clues for finding the way out of the predicaments the old "civilizations" have placed it in. A new wineskin in time must be of critical help for the advancement of humankind.

The 2002 production of Twelfth Night by Shakespeare's Globe Theatre Company is one of the most successful productions since the theatre's opening in 1996. Not only it played to the full house throughout its entire run but also it received a number of theatre awards that year, to critical acclaim for theatrical achievement. The production was originally staged in January at the Middle Temple Hall, one of the existing Inns of Court in London, to celebrate the 400th anniversary of the play, before opening at the Globe in May with a major cast change. By comparing Twelfth Night at the Middle Temple Hall and the Globe, this paper explores the following issues: the significance of Shakespearean performances in historical sites, physical conditions of theatre space and their effects on performances, and the new possibility of playing Shakespeare at the reconstructed Globe. The paper briefly refers to the company's another example of 'original practices' production, the 2004 production of Measure for Measure at the Hampton Court and the Globe.

This essay is an attempt to analyze and explicate The Old Man and the Sea by Ernest Hemingway from the viewpoint that the text represents the author's insight into man, particularly man when he is fighting. It discusses the ingenuity of the novelette's structure, the correspondences between the old man and the fish, the shifts in the old man's psychology, and nature's revenge against man's trespasses.

This essay presents a compact perspective for better understanding the postwar history ofJapan in terms of sex and media. History as a discipline has become increasingly broken downinto separate fields of study and the interaction of sex and media―usually dismissed as a subjectunworthy of mention―is isolated from political and economic history. By integrating sex andmedia into the so-called correct and authoritative, and therefore often quite defective, discourseon history, we can approach a more holistic view of our past, and thereby consider moreappropriately the relationship of the two.

Some relationship among the individual choice competence, the number of individuals in the group, its decision rule and the collective choice competence was initially investigated in Condorcet's Jury Theorem. Although several researchers have devloped the theorem in different directions, they in common assume implicitly one collective choice area and introduce only the individual choice competence for the area. In reality, however, there may exist multiple collective choice areas such as 'management strategy and personnel changes planning' and the individual choice competencies may be different for the corresponding area such that 'he/she is good at management strategy but not personnel changes planning'. Under the multiplicity of choice areas and the difference in competencies, how should the group assign what members in it to what collective choice area? Tomiyama (1991) extends the basic model under Jury Theorem to the model of two collective choice areas and formulates in general the group two-decomposition problem. It also gives a solution to this problem under the complete homogeneity assumption that all of the members in the group have the same competence of individual choice for all of the collective choice areas. This paper analyses the problem under the heterogeneity assumption. It is proved that individual rationality and social rationallty may not be compatible. The high-competence decomposition is used to represent individual rationality, and the maximum-sum decomposition and the minimum-difference decomposition are used to represent social rationality. Finally, some unsolved problems are showed.

Nowadays, many people call themselves animal lovers. Stories of the maltreatment of animals are reported sensationally by the press to attract wide public attention. But all animalsare not paid the same attention: the killing of some animals draws more sympathy than others; the experimentation of some animals arouses more indignation than others. Whales are among those 'chosen' animals that are given special consideration, especially in the West. What makes whales so special in human eyes? Why whales, not other animals? In this article, I address these questions by critically examining the alleged uniqueness of whales proposed by a whale protec-tionist.

人間科学的研究の方法論的側面を再検討するプロジェクトの一環として、名古屋大学の広瀬幸雄教授によって作成された仮想世界ゲームが論じられた。2002年度に群馬大学でおこなわれた実施例の概略が報告され、最後に人間科学的研究における実験的手法の意義が、社会的リアリティという観点から議論された。As a part of our recent project on reconsidering methodological aspects of researches in human sciences, Simulated International Society (SIMINSOC), constructed by Prof. Yukio Hirose of Nagoya University, was discussed, while a case conducted at Gunma University in 2002 was reported briefly. Finally, the problems of laboratory experimentation of social phenomena were argued in the light of social reality.

The penal regulations which impose legal controls and inflict punishments on speech and writing should be presumed unconstitutional. In order that the provisions on sedition of the Anti-Subversive ActivitiesAct may be taken constitutional, the following requirements should be satisfied. (1) It should not be permitted to punish the accused by reason of mere seditial action. (2) It should be recognized that the critical conditions of actual harm may come into being concretely.

瀬石『こころ』のKはなぜ自殺したのかという問題は、以前の拙稿(1999年)で、他のいくつかの問いと共にとりあげたことがあったが、そこでの議論は不十分であった。本稿はこの問題を、日本倫理思想史の全体にてらして再考する。Kは真宗の教義としての阿弥陀崇拝に、殉ずる形で死んだのではなかったろうか。それは、まさに彼の生家の宗旨として信仰され続けていたものでもあった。

In this article consideration is given to the Kobe case, which was brought about by a fourteen-year-old boy A in May 1997. Why did he have to murder a girl of ten and a boy of eleven, and especially, why did he kill the boy in a cruel way? The cause was probably A's fear of abnormality of his own, and his mother's fear of abnormality itself might contribute to her son's commitment of the cruel murder.

Zwar hat das Konzept ""der Bildung"" in Deutschland und auch in Japan eine groβe Rolle gespielt, aber es scheint, dass sie heute nicht mehr fur einfluβreich gehalten wird. In dieser Abhandlung wird versucht, darauf zu antworten, wie sich die Geschichte der Bildung in beiden Landern entwickelt hat, warum die beiden Bildungsburgertume vergangen sind und was fur die japanische Bildung im Vergleich zu der deutschen charakteristisch ist. Obwohl die Blutezeit oder die Groβe der beiden Bildungsburgertume verschieden ist, kann man folgende Charakter der Bildung als gemeinsame nennen: aristokratisch, idealistisch, geistig, innerlich, personlich, humanistisch, pseudoreligios, individuell. Ein weiterer gemeinsamer Punkt ist, dass der Aufstieg der Massengesellschaft die Bildung und das Bildungsburgertum veraltet und kraftlos gemacht hat. Weiterhin ist zu erwahnen, dass die Bildung nicht unanhangig von den politischen Ereignissen ist: Die Franzosiche Revolution hat im weiteren Sinne die deutsche Bildung gepragt und die Russische Revolution die japanische. Und das Ideal ist auch ganz anders. Die deutsch Bildung richtet sich nach der griechischen Welt, die japanische nach der damaligen europaischen.

Comparing automatically organised set of medium or small size firms with vertically integrated firms that appeared in United States, Alfred Marshall finally judged that the former had been more effective than the latter through the 19th century. But, during the decades around the turn of the century, Marshall was afraid that international economic leadership would be shifted from British proprietory capitalism to U.S managerial capitalism, and appreciated the advantage of the vertically integrated firm. Neverthless, he believed tht the British industrial-organizationis expected to keep its conpetitiveness in the long run. However, Lancashire cotton industry has been declining after 1920 (Marshall died in 1924), and betraied his confidence. In this article, we want to analyse the reason why Marshall insist of such industrial-orcanization In relation to the success and decline of Lancashire cotton industry.

It would be true that talking critically of Coleridge's Biographia Literaria is almost equivalent to saying something about the relationships between the author and Wordsworth. It is also correct in thinking that the work is a kind of counterstatement to Wordsworth's writings. But these interpretations, which have been provided by many critics, are not enough to develop a comprehensive understanding. The Biographia exists based on Coleridge's multiple relations to the contemporary literary situation, himself, Wordsworth, and "oral cultures." Of those, the relationship between Coleridge and Wordsworthis central, but interrelationship of those four is more important because they cooperate to determine both the content and mode of the work. Through the analysis of these relations, especially those with Coleridge himself and "oral cultures," the Biographia appears to be different from a simple autobiography which concerns the public figure of the author or an earnest defense against censures from the literary circle. Considering its abundant characteristics stemming from "oral cultures" and the importance of Wordsworth as a counterpart of the author in the work, it presents itself as an autobiographical open letter to the poet. There Coleridge "talked." about himself to compete with Wordsworth, in the public field, as a philosophical literary critic. More importantly, then, this feature is where the work's significant originality derives from. The Biographia is not only an anti-Romantic autobiography, but also realizes an entirely new mode of the genre which represents a "private" figure of the author depending on the real personal relationship between himself and Wordsworth.

On October 11, 2006, DOJ closed its investigation into the AT&T/BellSouth merger withoutfurther action. On December 29, 2006, FCC approved it. The competitive framework formedduring the preceding SBC/AT&T and Verizon/MCI merger proceedings was strengthened withthese approvals. However, the scope of the merger remedies including those ensured in themerger commitments is not so broad. They mainly focus on existing communications networksbased on PSTN, including no small parts of the Internet. Problems raised by the NextGeneration Network (NGN) and Fixed Mobile Convergence (FMC) are yet to be solved.Government authorities should make the comprehensive framework based on the layers modelfor the future.

On October 27, 2005, DOJ approved the SBC/AT&T and Verizon/MCI mergers. On October31, 2005, FCC authorized them. In these consent degrees, DOJ conditioned the divestiture ofsome special access connections to some buildings in these RBOCs'in-religion territories. Inaddition, FCC accepted voluntary, enforceable commitments made by the applicants as mergerconditions. These decisions altered the competitive framework of the U.S. telecommunicationsindustry since 1984, when former AT&T Corporation was divested. The TelecommunicationsAct of 1996 succeeded to the framework, and hypothesized that the PSTN continues to be theunrivaled infrastructure for the industry. Nevertheless, the rise of the IP-based networks hasoutdated it. FCC tried to modify the framework to accommodate to the Internet age.However, these adjustments also caused asymmetric regulations, which have caused a greatnumber of lawsuits since the AT&T Corp. v. City of Portland, 43 F. Supp. 2d 1146.Comprehensive legislation by the Congress based on the layers model is indispensable for thefuture.
