能動的な政治主体の構成員をいったいどのような名前で呼べば良いのか。「良民」 か 「士族」 か, はたまた 「士民」 か (「市民」 なる語はかなり新出来である)。東アジア世界の近代に共通の難問のひとつの解として, 1920年代以降, 急速に浮上したのが 「公民」 という概念であった。本稿では, 蠟山政道の 『公民政治論』 (1931年) に焦点をあて, この 「公民」 概念が同時代の 「政治と教育」 問題を考える上での鍵概念であることを示そうとした。    蠟山は 「公民」 について, それを 「社会の発見」 に引き付けて理解しようとする同時代の他の論者 (たとえば大島正徳) とは異なり, 終始, 政治的存在として理解しようと試みた。蠟山にとって, したがって, 公民教育とは政治教育であり, そこでは多数決の意義や政党の持つ積極的な道徳的意味が教えられるべきだった。    政治を教育や倫理と不可分とみなすこうした蠟山の政治観は, 政治をあくまで権力の体系, 目的達成のための手段とみなす丸山の政治観とは異なっていた。

How and why do nation-states require loyalty from its people? In the discourse of "liberal nationalism", nation building is considered a necessary condition for the construction of liberal democracies. While it is widely believed that the nation-state as a political unit is an important framework underpinning political stability, throughout history one can find many examples of nationalism that has deconstructed democracy. It is for this reason that the actual relationship between nationalism and democracy should be examined. To consider this relationship, in this paper, we will first discuss the moment when loyalty is required of the people, especially the political dynamism surrounding the notion of philanthropy in the United States. Within the concept of philanthropy, the rich and successful seek to support the next generation and new immigrants. However these social ethics are located within efforts of the elite to reduce the national budget dedicated to social welfare. It is here that the state uses the citizen's loyalty for its own benefit. Secondly, we will demystify the discourse of the leftwing nationalists in the US, especially that of Richard Rorty, who emphasizes aspects of the democratic function of American nationalism, but whose theories also rely upon a complicated and subtle form of ethnocentrism. His arguments are seen as problematic when used to support democratic theories, because the people demonstrate loyalty to the state via ethnocentrism.

This article analyzes a policy-making process for revised Japanese copyright law to add provision for computer software. The policy outcome of this process had been made through the conflict between the Agency for Cultural Affairs and the Ministry of International Trade and Industry. The paper describes the conditions under which administrative conflicts, as a result of attempts to control new policy areas, arise and are settled. Previous research shows that such conflicts are viewed as administrative competition for additional resources. In order to modify this understanding, by introducing “autonomy” and “vigor,” the author argues, as previous studies have shown, that conflicts between both agencies pursuing vigor tend to lead to deadlocks and need arbitrators (e.g. politicians) to provide resolutions. Conversely, conflicts between agencies pursuing vigor and ones pursuing a degree of autonomy tend to be resolved without such arbitrators as policy outcomes satisfying both interests arise when the agencies’ goals are different.

The gated communities risen in U.S.A. and similar excessively secured collective housings in Japan would inevitably cause the exclusion from outer communities, leaving them as “the closed space”, which have harshly been criticized.   However, I wish to maintain their private government basing on the direct democracy with participatory and deliberation modes will certainly breed the excellent commonality among all the people there, which will easily be extended and elevated to the public. The commonality based on the democracy, thus, will go beyond “the closed space” to the city/town level, furthering even to the national level, which is the subject of my paper “the despatial democracy”.

Social hospitalization of the elderly people has said to be the biggest pathology in the Japanese medical supply system and it was the main policy problem to be solved for a long time. Although it was not completely solved, it is just in sight in the Ministry of Welfare (Ministry of Health, Labour, and Welfare) having promoted differentiation of medical function and promotion of coordination policy since 1980’s. The policy consists of three points; first one is to differentiate medical function between acute care and chronic care, second one is to promote discharge by Bundled payment in revision of medical fee, third one is to provide both facility and in-home care service. This report explores about the factors that the Ministry of Welfare could promote through the view point of “Policy Learning”. This report revealed that the Ministry of Welfare has learned the elements of European and American eldercare service formulated the policy by constraining it to existing institutions under the administrative reform since 1980’s.

In recent work, Jürgen Habermas develops the idea of “postsecular society” to respond to the fact that religion continues to be influential, far from withering away. In order to reflect religious voices in public sphere while maintaining the principle of political secularism, he argues for the idea of “cooperative translation,” according to which religious and secular citizens work together on translating religious claims into secular ones. Critically examining Habermas's idea of “cooperative translation,” this article attempts to point out two problematic issues involved in this idea. First, by focusing on different requirements that the idea of “cooperative translation” imposes on religious and secular citizens respectively, it claims that those requirements are potentially detrimental to the polyphonic nature of public sphere. Second, it critically considers what Habermas means by “translation,” thereby showing that the idea of “cooperative translation” is based on the logic of convergence, but not on that of consensus, hence being in tension with the discourse-theoretic foundation of political legitimacy.

While recent studies have emphasized the importance of colonial studies in the vein of Yanaihara Tadao as a discipline dealing with issues arising from international migration, this article suggests that studies of private international law addressed similar issues. Since private international law presupposes the coexistence of different sovereign states with their own legal systems and the movement of people among them, scholars of modern private international law had a strong interest in migration-related topics such as the admission of foreign nationals and the legal status of resident foreigners. This article focuses on one of the pioneering scholars of private international law in Japan, Yamada Saburô, and argues that his views on international migration, while based on Règles internationales sur l'admission et l'expulsion des étrangers adopted in 1892 by Institut de droit international, presented his original idea, kyôdô seizon (community life or simply community).
