I discussed the standard of proof in the criminal suit under the title of ‘‘The Principle of the Free Discretion of Judges as to the Probative Value of Evidence and ‘the Degree of Proof’ ”published in Memoirs of Faculty of Education and Human Studies, Akita University No.65, 2010. I insisted there that ‘‘the preponderance of evidence” would be enough for the prosecution to convict the accused of a crime. In the same way as in the criminal case, a plaintiff does not have to produce evidence to such an extent as to make the judge confident that his claim is well-grounded. Because it is not going too far to say that both parties have no conclusive evidence in the civil action. ‘‘The Burden of Proof” nowadays hotly disputed in the Civil Proceedings Law Society, therefore, is a sterile flower caused by the unreasonable demand from the plaintiff.

About 1930, two literary schools, Proletarian School and New Art School (Shinkogeijutsu-ha), attracted attention in the Japanese literary world. In the studies of Japanese modern literature, these two have been argued separately as the opposing schools of the political and the artistic avant-garde. However, there is commonality that the contemporaneity around 1930 and the impact of economy on society are the themes of the novels. In this paper, from the viewpoint of such commonality, we will take up the following two works that show the sprouting of economic novel. They are "Kyoukou" (Panic, 1929) written by Einosuke Ito and "Jinsei Tokkyu (Life Express, 1932) by Toyohiko Kuno. The theme of "Kyoukou" was the current state of the Japanese society that represented the Showa financial crisis in 1927 as a model. "Jinsei Tokkyu" depicted the Japanese society in 1932 that was influenced by the financial capitalism from a critical viewpoint of Marxism. Both Proletarian School and New Art School tried "co-writing" (Kyoudouseisaku) novels in 1930. This is because they tried to draw out the current society diversely from a broad perspective. However, that caused the loss of the role as avant-garde for the two literary schools.

This article reconsiders relatively recent critical arguments about Raymond Murray Schafer's concept of 'soundscape', especially the arguments of two articles: Ari Y. Kelman (2010) 'Rethinking the Soundscape: A Critical Genealogy of a Key Term in Sound Studies' and Stefan Helmreich (2010) 'Listening against Soundscapes', in order to re-explore 'rich vein of scholarship of sound' (Kelman) in the concept of soundscape.Attending 'to the invention of Schafer's idea in order to wrestle with its redefinition', Kelman criticizes Schafer's bias against noise and his confusion of sound and listening, but Kelman does not consider deeply the definition of soundscape. This article reconsiders the definition of soundscape through rethinking Schafer's explanation in The Tuning the World, Helmreich's discussions of 'soundscape', 'immersion' and 'transduction', Steven Feld's 'acoustemology', Tim Ingold's 'against soundscape', and Paul Rodaway's 'aural geography', in that it situates the concept of soundscape in developments of studies on sound. This article also makes clear the concept of soundscape is not in conflicts with 'transduction', 'acoustemology' and 'immersion', and it needs to be connected with a central and traditional problem of social theories: the relationships between the individual and the social, and depending on how to make this connection, there are possibilities to develop various conceptions of soundscapes.

In the present study, the fluctuations in the sex ratio of the ostracod Vargula hilgendorfii (Müller, 1890) were studied. Specimens of stage-5 juveniles (last instar) were collected from Akita Port every 5 or 7 days and were reared until they reached maturity. The sex of the adults was identified under a stereomicroscope to determine the sex ratio. The sex ratio varied among collection dates, whereas at the beginning of the generation, the sex ratio was 1:1, a female-bias was apparent in the middle of the generation. These fluctuations were also observed in the second generation. This same sex ratio fluctuation was also observed in 2010 and 2011. These results revealed that the sex ratio varied among collection dates and suggested that sex determination is related to some specific environmental factors.

A questionnaire survey was conducted on teachers at schools for special needs education to identify the current state of development and use of individualized education support plans and to examine into policies aimed at effective application of such plans. The findings show that the teachers found development of such plans burdensome and that such plans were not being utilized effectively. For individualized education support plans to function effectively, support meetings by relevant parties, study in application systems and participation of special needs students and their guardians in plan development are regarded necessary. The findings reveals that in developing such plans it is necessary to study into formats that are suited to the real conditions at the school and to promote further coordination among relevant organizations. Additionally, it is suggested that the cooperation between the school and the students and their guardians will possibly contribute to career development of the student.

The purpose of this study was to examine the effects of language training in a formation of referential function of word as receptive language for severely child with intellectual disabilities. The subject who was 10 year-old boy with intellectual disabilities, was given six language training tasks for a year and half to form referential function of word. The tasks of this language training involved: 1) formation of identificative and discriminative action with objects, 2) formation of concrete action with objects, 3) formation of classificative action with objects, 4) comprehension of a relation between objects and their sounds, 5) formation of symbolic gesture with objects, 6) formation of referential function of words as receptive language. The language training were arranged to gradually trigger the transformation of concrete actions to inner speech. The main findings were as follows: (1) The subject learned identificative, discriminative and concrete actions with objects in the language training process. Multiple effects were observed between the formation of concrete actions with objects. The formation of these actions generated a formation of representational function with objects. (2) Comprehension of a relation between objects and their sounds, and formation of referential function of word as receptive language. These findings indicated the language training are effective in the formation of referential function of words as receptive language for severely child with intellectual disabilities.

So, what peace education is conducted in the present study, based on previous research, school education teacher training, or its present research and analysis to like. Featured continued pioneering initiatives for peace education as a specific case study, Hiroshima City and Nagasaki City, Naha city, I want to analyze and attention to the positioning of peace education in teacher training, structure, curriculum and teaching materials.

The general of Tokugawa shogunate gave daimyos "Ryochi-hannmotsu", the certificate of the governance on the region and "Ryochi-mokuroku", which describes the contents of the region. However, Ryochi-hannmotsu from the first general Ieyasu Tokugawa to Daimyo Satake in 1602 did not contain "Kokudaka", the size of the region. Daimyo Satake got Ryochi-hannmotsu and Ryochi-mokuroku for the first time from the fourth general Ietsuna Tokugawa in 1664. Although the kokudaka in the Ryochi-hannmotsu was 200000-koku, the sumu of the kokudaka at each district described in the Ryochi-mokuroku was 199320-koku. This paper focused on this discrepancy for the first time and provided the premise to investigate the 200000-koku region of Daimyo Satake assured by the general.

Welchen Einfluss ubte der Nationalsozialismus als zuvor pragende Kraft nach 1945 in der westlichen Besatzungszone im Bereich der Erziehung aus, und welche Zusammenhange konnen aufgezeigt werden? Diese Fragestellung ist sehr wichtig, weil die Bewaltigung der nationalsozialistischen "Vergangenheit" eine Hauptaufgabe der Bildung seit 1945 war und blieb. Diese Frage wurde ursprunglich bereits von oppositionellen Gruppierungen im Rahmen des burgerlichen Widerstandes wahrend der NS-Zeit gestellt. Ein zentrales Motiv der Gruppen war das Ziel, ein "geistiges Erwachen" fur die Zeit nach einem Umsturz des Hitler-Regimes herbeizufiihren. In diesem Sinne kann der zivile Widerstand als stark menschenbildend charakterisiert werden, wobei eine vom christlichen Humanismus gepragte ethische Ideologie zur Neuerziehung der Bevolkerung ein zentrales Anliegen war. In der vorliegenden Arbeit mochte der Autor am Beispiel des Widerstandes versuchen, bisher unbewaltigte Probleme der Erziehung in der Nachkriegszeit aufzuzeigen und Erklarungsansatze zu formulieren, wobei vor allem Bezug auf die sogenannte Westzone genommen wird. The purpose of this study was to investigate effects of expectancy and attitude toward hypnosis onhypnotic susceptibility. Participants rated an attitude toward hypnosis questionnaire and a hypnotic stateexpectancy questionnaire. Then, they completed the Harvard Group Scale of Hypnotic Susceptibility, FormA. Factor analysis of the hypnotic state expectancy questionnaire yielded two factors: expectancy for lossof control and released potentiality. The result of two-way analysis of variance showed a significant interaction.Low expectancy for loss of control participants demonstrated increased hypnotic susceptibility fromlow to high level of attitude toward hypnosis. This finding suggest the importance to investigate effects ofexpectancy and attitude in terms of interactive these variables.

The term “Education” is widely settled in modern social life. This term has infiltrated as which everyone can use very generally, therefore the meaning or the concept of the term “Education” is not so clear. Of course, in the past pedagogical studies, the effort to investigate the definition of the term “Education” has been positively performed to some degree. But many assertions of these studies were that which might not pass an analytical examination and that were without general validity. However, things concerning the Education habe come to be shared socially and problems of it are being discussed seriously in our society. So to strengthen the basics for the plentiful theoretical communications on the Education, it is necessary for us to investigate the essence of Education by appropriately analyzing the definition of the term “Education”. So this paper aims at submitting the “explicative definition” of the term “Education”. That is, this paper tries to specify an realistically actual perspective of the term “Education”, with confirming in what meaning the term “Education” has been used in some specific communities on the history of educational thought, and therewith making the concept of the “Education” more accurate. (This paper is a second part of our study.)

From Lake Hachiro in Akita Prefecture, one compound hydra, Cordylophora japonica, was reported in 1976 (Toriumi, 1976). On the other hand, Ishii has been seeing solitary hydras in Lake Hachiro since 1996, however, he had not investigated those hydras. In this report, two species of freshwater solitary hydras have been described. In this report, taxonomy of Hydras in Japan is based on the reports by Ito (1947a-d). Hydra magnipapillata and Hydra japonica collected from Lake Hachiro in 2011-2012 had been firstly reported of living in Akita Prefecture.

Provincial performing arts in Akita prefecture called “Sasara” can be sketchily grouped into two styles and respective manner of Sasaras are mainly distributed in Northern and Central (Senboku) regions of the prefecture. Additionally, each local settlement has characteristic manner of Sasara, and each Sasara is supposed to have been established under influence of different kind of Sasaras performed in other regions, which have been brought on by “Wakaze”, labors of farming families, and transmitted by some reasons. In Tsuzureko (Kita-Akita city) and Fujikoto (Fujisato town) areas located on the Northern part of the prefecture, Sasaras have been separately handed down by both “Kami(Upper) and Shimo(Lower) communities. Rivalry between the communities as well as a system encouraging children to participate in Sasaras could have contributed to carrying on the tradition. In these areas, some community associations are taking certain role in handing down provincial performing arts across the entire community and cultivating successors, which might be a good role model to maintain the traditions going.

Descartes (lS96-16SOlis the first figure who proposed body-mind dualism based on his own rational arguments, not based on any allegorical or philosophical interpretations of the Bible, which was primarily acceptedas the absolute authority. In this paper I critically examine Descartes' arguments, and point out his wrong strategy. that is, we ought to exclude as false all these things of which we may doubt. I claim that Descartes' philosophical opinion is not the sole absolutely certain truth, and I propose another option.
