本稿ではまず、カントとヘアをつなぐキーワード(言い換えれば、ヘアによるカント解釈のキーワード)である普遍化可能性 universalizability の原理に着目し、この原理と道徳判断 moral judgment がそこにおいて下される状況の特殊性 particularity との関係を検討していくことにする。According to R.M.Hare(1919-2002), one of the most eminent moral philosophers of the 20th century, who carries the spirit of Kantian universalism, every judgment must follow the principle of universalizability. On the other hand, moral universalism has been criticized as a mere illusion by communitarians, e.g.A.MacIntyre(1929-). In this paper, I will argue first that it is not to the point that the principle of universalizability disregards the particularity of situations, and then that there is a genuine difficulty in drawing a line between the morally important features of them and those which are unworthy of attention. In my opinion, this problem is no other than that which I.Kant(1724-1804) tried to solve in his Critique of the Power of Judgment (1790), so we must be able to receive many suggestions on this problem from this work.

本稿では、利益供与禁止規定が本来何らかの違法性を帯びる取引を禁止していたことを基本として、その適用範囲ないし要件を確認してみようと思う。なお、議論のほとんどが平成17年以前の商法における利益供与の禁止規定を前提としているため、本稿もこの規定を主として扱い、特に断らない限り「商法」は会社法制定前の商法会社編を指すものとする。

最近、証言拒絶権が問題となった一連の国際司法共助事件が発生した。米国裁判所に係属する損害賠償請求事件に関して二国間共助取決めに基づいて日本における証人尋問が嘱託され、日本の裁判所がこれを実施する中で、証人である記者が取材源の秘匿を理由に主張した証言拒絶権の存否が問題となったのである。事件を扱った下級審裁判所の中には、尋問事項の一部について証言拒絶を認めないものも出たが、最決平成十八年一〇月三日は、日本の民事訴訟法一九七条一項三号の解釈として取材源の秘匿に重きを置いた利益衝量により証言拒絶を認める決定をし、その後の事件処理においては、記者の取材源秘匿を認める証言拒絶権の行使が肯定されていった。本稿は、この事件を契機として、国際民事訴訟における証言拒絶権について、その法選択問題に関するアメリカ法律協会『抵触法第二リステイトメント』の関係諸規則を検討するものである。

多分化能を持つ胚性腫瘍P19細胞を、1nMレチノイン酸存在下で浮遊培養すると、約10%の細胞塊に搏動を伴った心筋が出現する。これを長期培養後、細胞をクローン化し、通常培地では増殖し、1%ジメチルスルホン酸(DMSO)存在下で高頻度で搏動細胞に分化する細胞を選択し諸性質を検討した。CL6細胞と名付けたサブクローンは、親株のP19細胞と異なり坑SSEA-1抗体とほとんど反応しない。さらに分化は接着状態のままで誘導され、シートを形成し分化誘導後10日目に搏動が始まり、14日頃にはシート全体が搏動した。またDMSO添加後2日毎に全RNAを抽出しノーザンブロット分析を行なったところ、CL6細胞では胚性の心筋型ミオシン-α及び-βの発現が10日目から見られ、一方骨格筋特異的な分化制御因子であるMyoDやマイオジェニンの発現は検出されなかった。ウエスタンブロット分析でもミオシンの発現が10日目に始まり、これは搏動が観察される時期と一致した。この条件下ではほとんど搏動の見られないP19細胞では14日目にかすかなミオシンバンドが検出された。また搏動細胞を固定し、蛍光標識したMF20抗体、ファロイジン、坑デスミン抗体そして坑心筋型c-蛋白抗体で細胞が染色され、横紋構造が確認できた。リズミカルに搏動している細胞へのアセチルコリン及びアトロピンの添加実験では、分化細胞の搏動がムスカリン性アセチルコリン受容体によって影響を受けることを示した。また親株p19細胞の神経分化条件では、低頻度の神経分化能がみられたので、CL6細胞は心筋細胞分化にコミットメントはしていないが、p19細胞より心筋分化しやすいところに位置する細胞と考えられる。従ってCL6細胞は、心筋細胞へのコミットメントや分化のin vitroでの研究に有効と考えられ実験を進めている。

The purpose of this research is to clarify the modes of understanding and attitude of classroom teachers who are put in charge of foreign students in Japanese elementary schools. In areas where there are few foreign children, the ways of accepting and guiding them as newcomers in the elementary schools are left to the classroom teachers. In many cases, these teachers have to struggle with the new types of challenges brought by foreign students without useful help and support. At the same time, adaptation of foreign students to Japanese school life depends on the classroom teachers' attitude and behaviors. The interviews of teachers and the observation of the school life of foreign students bring us the findings as follows: 1) classroom teachers recognized foreign children as a new type of student that they have not experienced and they have to struggle with acceptance and guidance of these students without suitable preparation, 2) the "barrier of language" is understood to be the source of most difficulties by classroom teachers and this understanding seems to make them ignore the other problems of foreign students, 3) classroom teachers have trouble with the conflict between cultural context and personal context when they face problems regarding the behavior of foreign students, 4) understanding of the support necessary for the learning of foreign students differs slightly among classroom teachers, so the support provided to these students is, in fact, not consistent, 5) classroom teachers need and demand support services and advisers which can help to resolve their problems in acceptance and guidance of foreign students.本研究では、外国人散在地域U市において実施した現地調査の結果から、小学校の学級担任教師のニューカマー児童に対する認識と態度を捉えようと試みた. 学校現場でニューカマー児童の受け入れと指導に苦慮している学級担任教師に共感しつつ、受け入れの過程でどのような困難や課題に直面するのか、また、それらの困難や課題にどのように対処しているのかを明らかにし、散在地域の学校現場における多文化教育の課題と今後のあり方を探る一助としたい.

First, this paper explores the recent use of English proficiency tests as external tests at higher educational institutions. External tests such as TOEIC, TOEFL, and Step Test (Eiken) are used because they enable us to measure English communication ability and to compare the results at several stages of teaching and learning. Higher institutions make use of these test scores to motivate students and innovate EFL teaching and learning. Second, the paper reviews research at Kumamoto University which examined an English program which incorporated the TOEIC-IP score into the final grade of one required English class. Third, the results of the author's classroom research are reported: sutudents planned their learning during the samester using CASEC (a computer-adaptive test) scores. Students' comments on the effects of the external test on their learning are presented. Finally, washback effects of external tests on EFL teaching and learning at higher insitutions are discussed.

能動的振動制御システムを最も効果的かつ一般的であると思われるロバスト適応制御手法を利用して構成する研究を、申請した研究計画に沿って実施し、以下に示す結果を得た。1.能動的振動制御とそのオンラインロバスト適応制御系構成に関する研究。適応制御手法を振動系制御に適用する場合、オンライン制御計算時間の短縮、振動の周期性の利用、適応アルゴリズムのロバスト化等が問題となる。これらについて考察し、離散時間適応極配置、適応繰返し制御、適応オブザーバ使用等について成果を得た。なお、成果の一部は既に公表した。2.サーボ機構を利用した振動制御装置の試作と実験。実験室レベルでの制振実験装置を試作し、通常のサーボ機構を用いて上記1.の理論が実際に有効に働くことの基本的な確認をおこなった。その結果、固定壁面が利用できる振動制御方式では適応制御方式が非常に有効であることを確認した。また、より応用範囲が広いと思われる動吸振器構造の振動制御装置においても、同様の結果が得られることが確認できた。これらの成果の一部はすでに公表したが、その他についても現在論文として投稿中である。3.スライディングオブザーバー使用によるロバスト振動抑制適応制御手法利用時におけるオンライン計算時間短縮のため、スライディングオブザーバを利用する振動抑制手法を考え、理論的考察をおこなった。特に、スライディングオブザーバを含む閉ループ振動制御系の安定性を一般的に考察し、外乱ロバスト性を含む安定条件を導き、制御系設計時におけるパラメータ設定条件を得た。

The purpose of this study is to define the identities of occupational therapists' inrelation to that of nurses. The author explores three points as background for thestudy; 1. Occupational therapy is considered as part of nursing practice. 2. Theprocesses in clinical practice differ between nurses and occupational therapists. 3. The roles of nurses and occupational therapists in the convalescent rehabilitationward differ. The author concludes with no apparent reason to distinguish theidentities of occupational therapists' and nurses.
