商学部創立50周年記念 = Commemorating the fiftieth anniversary of the faculty50周年記念論文ライブドアの粉飾事件に関連して,会計基準等がない取引の会計処理について会計専門家はどのように考えるのか,裁判所の証人となった。証言の対象となったライブドアとクラサワ(K社)との株式交換(交換日(2004年3 月15日)は契約日(2003年11月19日)の4 ヶ月後)に関連して,まず子会社(投資事業組合を通して)が消費貸借により取得した親会社株式を売却(2003年12月2 日~19日)し,その後,株式交換日にK 社株主から親会社株式を取得(株式交換契約日(2003年11月19日)に売買契約を締結し1 週間後に前金を支払う)のうえ返還するという一連の取引について,事実関係を可能な限り明確化してみると,株式交換における交換比率の操作とそのLD株式買取契約の結果生じた含み益を実現するためのスキーム取引であることがわかる。この一連の取引について,有価証券消費貸借契約の会計処理の対象,その処理方法,民法上の任意組合の法的性格と会計処理,自己株式処分損益の性質及び会計処理,自己株式の借換えの会計処理,そして親会社株式の取得という商法違反である取引から生じた処分損益の会計処理という6 つの論点に整理した上で,各論点について歴史的経緯を含め検討した。その結論は次のとおりである。 自己株式の消費貸借については,自己株式等会計基準に基づいて考える必要があるが,その消費貸借による取得と返還自体は,金融商品実務指針に基づいて処理し,その運用損益を自己株式処分差額として処理すればよい。投資事業組合は民法上の任意組合であり,組合の積極財産は総組合員の共有である。したがって,重要性を有する組合財産及び損益であれば,出資者は科目ごとに持分相当額を取り込むべきであり,その結果,子会社は親会社株式運用益を損益計算書上取り込むことになるが,それは税引後の金額で連結修正されることによって,親会社の連結財務諸表上,「自己株式処分差益」としてその他資本剰余金に直接計上されることになる。 しかし,この一連の取引はLD が計画・実行したスキーム取引であり,仕組まれたものであると解されることから,任意組合の会計処理を適用する以前に,親会社の連結財務諸表上,「自己株式処分差益」としてその他資本剰余金に直接計上すべきものと解される。

This paper investigated the effects of active/passive viewing on the visually induced motion sickness. Participants wearing a Head-Mount-Display (HMD) searched a target character in random dots and other characters projected on a screen using a video camera moved by them (active viewing). They could see a part of the screen and the movies displayed via the HMD were recorded. When they saw the recorded movie later (passive viewing) through the HMD, they felt motion sickness worth than before. This suggests that passive viewing induced severer motion sickness than active viewing.

Inazo Nitobe (1862-1933), known in the West as the author of Bushido : The Soul of Japan (1900) and as a high-ranking League of Nations official (1920-1926), sought to mediate between the West and the East by building "a bridge across the Pacific Ocean". In Japanese education, he contributed toward establishing a new style of character development named "shuyo", which was designed to instill "culture" or "Bildung" through the reading of Western literary classics ; This approach was widely adopted among the next generation of educators under the name of "kyoyo". As an educator, Nitobe was practising this approach across the full range of Japan's social strata, but current academic opinion is divided as to whether he managed to exert a unifying influence on the country's social divisions. This paper examines Nitobe's educational legacy from a systems theory perspective, applying Niklas Luhmann's (1927-1998) reassessment of the inclusion / exclusion relationship.

平成12年度実技試験「排泄」の得点状況を分析し,難易度の高い行為を明らかにした。難易度の高い行為は<共通不可欠要素>では「清潔・不潔の区別」「無理・無駄のない動作」「安全・安楽,プライバシー」であり,<核となる要素>では「陰部,肛門部をちり紙で拭く」「腰部を挙上し,寝衣を腰の上まであげる」腰部を支えながら便器を挿入する」であった。また,難易度の高い行為の特性は'現実に生じていないことを自分でイメージして行なわないといけないもの''差恥心が強く生じるもの''左右の手で同時に別々の動きをしなければならないもの'であることが明らかになった。今後の演習指導としては,排泄物というリアル感をもたせるための工夫が必要である等が示唆された。

This study examined gender differences for two measures of mental health as related to the quality of the marital relationship. Middle-aged respondents (221 female; 210 male) rated their marital satisfaction, affection, and communication. They also rated their psychological well-being and depression. The correlations between marital quality and mental health indicated that for males marital quality was more strongly associated with psychological well-being than with depression. Females showed no such difference, or their marital quality was associated with depression. This implies that for females, depression was a more sensitive measure of their mental health related to their husband-wife relationship. On the other hand, for males subjective well-being which was correlated with self-esteem was a more sensitive measure of their mental health.

悪徳商法における強制的な説得・承諾のプロセスを,より詳細に検討するために,本研究では,被害者に対するインタビュー調査をおこなった.そして,説得の開始から承諾にいたるプロセスを,TEMを用いることで,詳細に記述・分析を行った.調査対象者は20代女性3名であり,彼女らはエステ・補正下着の強制的な勧誘を受けていた.TEMの分析によって,エステ・補正下着の勧誘のプロセスは,「来店」「勧誘」という必須通過点(OPP)を経て,「契約する」という等至点(EFP)に至ることが示された.そこでは,「友人の勧め」「無料体験」「脅し・強い勧誘」などの圧力が働いていることも示された.

It was the life's work of P.B. Shelley to discover the relationship between ascendance and submission. His works which include poetry and prose express revolutionary suggestions on the contemporary world. Shelley regards the contemporary world as being in a state of imperialism caused by the advent of Industrial Revolution. He endeavours to stop the spread of a disparity in wealth by Capitalism and to correct the egoistic posture of wealthy classes. He writes various works to create his ideal world. Shelley's Vegetarianism is one of his many attempts at protest. Shelley considered that eating had a great effect on creatures including human beings. Based on the idea that animal food produces physical and psychic corruption, Shelley inhibits animal food and recommends Vegetarianism. Shelley issued a pamphlet about Vegetarianism, therewithal he wrote a note about it in Queen Mab (1813). In 1812 Shelley wrote "A Vindication of Natural Diet", which describes the reasons for and the significance of the Vegetarian Diet. In the essay, he tries to prove the idea that diet has an influence not only on people but on all creatures. As a meat diet brings people to fierceness based on vice, decomposition and selfishness, people have to abstain from a meat diet. If people and all other creatures change from a meat diet to a Vegetarian Diet, they will be calm, peaceful and even agricultural in character. Shelley regards the meat diet as the root of all evil in modem capitalism.

症例は47歳男性, 住所不定者。4歳時肺門リンパ節結核で治療歴あり。特記すべき合併症なくHIV陰性。病型b II 2, 喀痰塗抹Gaffky 4号全剤感受性の肺結核の診断で複十字病院命令入所し標準的化学療法開始。治療開始2力月目に一度喀痰培養陰性化するも, 内服は規則的と考えられたにもかかわらずその約2週後の喀痰で再排菌し, それ以降治療終了後も喀痰培養が断続的に続いた。薬剤感受性試験では再排菌以降の菌が多剤耐性化していたことが繰り返し確認された。RFLP分析では再排菌時以降の多剤耐性菌と治療開始時から排菌停止までの菌で菌株が全く異なることが判明し, Double-strain infectionによる多剤耐性肺結核と判断された。
