This research aimed at clarifying proper management of planting demanded from a legal viewpoint. First, Article 2 of State Redress Law and Article 717 of Civil Code were set as keywords, and the judicial precedent was searched, using the Internet database "law information database LEX/DB Internet". And the examples in connection with the accident that the falling trunk or branch of the tree hits victims directly were taken up out of the searched examples. And then, the other judicial precedent was supplemented by obtaining it from the court. Finally, six examples were summarized in the table, observing the regarded fact in the decision. As a result, the relation between the legal responsibility for manager and the contents of planting management on the judicial precedent for the accident that the falling trunk or branch of the tree hits victims directly could be clarified.

We all know that literary tradition has often associated the imagery of fruits in general with sexuality, but scholars and annotators so far have not noted that Marvell's reference to melons in 'The Garden' might be deeply bound up with the properties of cucurbitaceae. One of the typical properties, especially the medicinal ones, of cucurbitaceae is to bring down a fever. And it seems to have been believed that this kind of cooling effect was gained not only physically but also mentally. Under the section of 'The Physicke commodities of the Pompons and Mellons' in The Gardener's Labyrinth, Thomas Hill explains this medicinal virtue: 'The greater number of Physitians writes, that those eaten, doth mitigate the venereall act, and do abate the genitall seed'. It is highly probable that this kind of knowledge was available through Gerard's immensely popular herbal to the readers of Marvell's 'The Garden', or that his 'habit of incorporating influences in his poems from recently published printed volumes' urged him to allude to Hill's explanation of melons in the 1651 edition of The Gardener's Labyrinth. In 'The Garden', this healing property of melons fits in very nicely with the speaker's claim that 'When we have run our passions' heat, / Love hither makes his best retreat' (lines 25-26). Marvell's intended meaning might be ─ or at least the reader who knew this particular property of melons could detect ─ the irony embedded in the description of the speaker 'stumbling on melons'. He has just ridiculed 'Fond lovers, cruel as their flame' (line 19), but he himself, unaware of his own different kind of infatuation, falls in love with 'this lovely green' (line 18). By showing that this dendrophile has lost his footing and got carried away by the passion's heat, which melons were supposed to cool down, and perhaps by partly laughing at himself, Marvell cannot but suggest the ridiculous aspect of the garden-mania which another of his poems, 'The Mower against Gardens', thematises. The last section of this paper, by drawing attention to the fact that the speaker in 'The Garden' does not perform gardening labours, argues that Marvell's gardens, after all, are created in the mind and reaffirms the limits on the part of literary scholars of positivism in analyzing a work of art.

メコン川の流域国4か国は1995年4月5日「メコン川流域の持続的開発協力に関する協定」に調印した.同協定の交渉過程では,流域国であるタイとベトナムの確執に起因する交渉の行き詰まりを打開するためにUNDP(国連開発計画)が仲介役を務めた.国際流域における流域国間の係争に国際機関が仲介役として過去に成功を収めた例としては,インドとパキスタンによる係争を世界銀行が仲介した結果,1960年に「インダス川条約」が締結されたことが知られているのみであった.「インダス川条約」と「メコン川流域の持続的開発協力に関する協定」の交渉過程を比較すると,流域国および仲介役を演じた国際機関が置かれていた状況について幾つかの類似点が見られる.国際機関が国際河川における流域国間の係争に仲介役として機能し,かつ流域国を合意に導くために満たすべき要件としては,(a)流域国が係争の解決を指向し,かつ国際機関による仲介が不可欠であるとの認識を流域国が持つ,(b)特定の国際機関が先進国や援助機関の利益代表としての立場を保持する,(c)統合的な流域管理計画に固執しない,などを挙げることが出来る.

Although blasting is a quite efficient and economical excavation method, it is rarely applied to tunnel projects close to residential areas due to its environmental impacts, especially with regard to vibration and noise. Two key controls used to mitigate the occurrence of noise and vibration due to blasting are the use of small instantaneous explosives charges and the use of precise delay times to initiate the blast design sequence. An advanced electronic detonator, which has its precision of 0.01% of designed delay time and has made it possible to achieve precise initiation control in blasting, was introduced and used in a tunnel construction site in Japan. Testing of the delay times during blasting was carried out, the test results revealed the specific features and performance of the detonator to control the blasting vibration especially within a short distance of the tunnel face. In previous studies, several ways of simulating blasting waveforms were used. One of these, the Monte Carlo method, in which the production wave was reproduced by superposing a single wave had the potential to give good predictions of the production waves that might occur. Therefore, in this study, a similar way of simulating production waves was carried out. Section peaks in the production waveforms correspond with the detonation of each blasthole. These section peaks were found to follow the Weibull distribution, even though the section peaks might be influenced by amount of explosives, drill alignment, and geological inhomogeneity etc. More detailed simulation with consideration of difference in travel time and the change of the Weibull parameters with distance gives further precise results compared with the real production waves. This study leads more precise method of predicting production waves and of optimum blasting design.

The crustacean class Malacostraca,with over 22,000 species, includes commercially important members, such as crabs, shrimps, and lobsters. A few simultaneous hermaphrodites are known in this group, but self-fertilization was unknown. Here we show, through microscopy and breeding experiments, that the simultaneously hermaphroditic malacostracan Apseudes sp. (order Tanaidacea) can self-fertilize; individuals reared in isolation become hermaphroditic via a male-like phase and produce eggs that develop into fertile adults. Although selfing occurs in crustaceans like the Branchiopoda, in which simultaneous hermaphrodites have the sex ducts united, in decapods the separation of gonadal ducts and gonopores, specialized mating organs, and complex mating behavior appear to have constrained the evolution of selfing. In contrast, in most tanaidaceans, sperm is released externally by a male and reaches the eggs in the female brood pouch, where fertilization occurs. This mode of fertilization permitted Apseudes sp. to achieve selfing without large modifications in morphology or behavior.

A caricature can express an artist's impression of the target face.We propose an interactive facial caricature drawing system "NIGAO".Our aim is to create a system that can be used by anyone to synthesize a caricature with one's impression of the target face.NIGAO has two modes:"selection and adjustment of facial parts mode",in which the user can directly manipulate the location or geometry of facial parts,and "interactive genetic algorithm (IGA) mode",in which he or she can use [facial characteristics from] a group of caricatures to influence her desired caricature by selecting some of them as the dominant genes.Users can switch between modes when needed.We let 15 users imagine the faces of two famous people and synthesize their caricatures using NIGAO.Results of this experiment show that a caricature synthesized using the latter mode after using the former mode reflects the artist's impression of the target face better than caricatures synthesized using only the former mode.These results also demonstrate the effectiveness of NIGAO's interface for synthesizing caricatures.

近年,活性酸素は様々な炎症性疾患との関連性が示唆されており,様々な機構によって組織に損傷を与えることが知られている。活性酸素への防御については,生体内に備えられている内因性抗酸化システムに加えて,近年では抗酸化物質に注目が集まっている。白金ナノコロイドは,平均粒径約2nmの白金粒子が分散したコロイド状溶液であり,過酸化水素等の活性酸素を触媒的に消去する新規抗酸化物質である。そこで,われわれは活性酸素由来の炎症を白金ナノコロイドが抑制するのではないかと考え,基礎研究の第一歩としてヒト口腔上皮細胞を用いた<i>in vitro</i>実験を実施した。その結果,過酸化水素の添加による細胞活性の低下及び細胞からのIL-8産生量増加を,白金ナノコロイドが抑制することが明らかとなった。本研究より,白金ナノコロイドによる,活性酸素由来の炎症に対する抑制効果が期待される。
