英語圏の法哲学やイギリスの憲法理論においては一般に,「法の支配」の多義性・論争性が強調されるので,「法の支配」を「善き法の支配rule of good law」と混交する考え方は消極的に評価される.他方,日本の司法制度改革を理論的に主導した佐藤幸治の議論の特徴は,「法の支配」それ自体が本来的に「善きもの」であるかのように語る点にある.この語り口を可能にするのが,「法の支配」と「法治主義」の法秩序形成観における差異を強調し,前者の優位を論ずる佐藤の独特な「法の支配」論である.本稿は,戦後公法学の論争上に佐藤の「法の支配」論を位置づけた上で,現代イギリス憲法学の理論動向を参考にしながら,佐藤の憲法学説を批判的に検討する.そして,佐藤の議論のように,政治道徳哲学への越境を禁欲し,法理論の枠内で「法の支配」を厳密に概念構成する学説が孕む問題性を明らかにする.

1948年の7月5日から8日にかけて、詩人パウル・ツェランはウィーンからパリへの亡命途上にインスブルックに立ち寄った。そこでツェランは、雑誌『ブレンナー』編集長であり、詩人ゲオルク・トラークルの庇護者であったルートヴィヒ・フィッカーを前にして自作の詩を朗読している。それは結果的に、ツェランには淡い失意を残すものとなったのだが、インスブルックでの二人の会談は、第二次大戦後ウィーンにおける芸術家たちの交流のひとつの成果であり、オーストリア戦後文学におけるひとつのエピソードとして広く知られている。それにもかかわらず、ツェランの感じた失望の背景を探る研究はまだ少ない。本稿は先行研究史におけるこの間隙を埋めようとするものである。出来事を証言する数少ない記録であるツェランによる二通の手紙の分析をもとに、フィッカーとツェランが出会った当時の歴史的コンテクストを再確認し、その上で二人の出会い/すれ違いに新たな角度から光を当て直そうとした。フィッカーがツェランの詩を、トラークルにではなく、ユダヤ人詩人ラスカー=シューラーにたとえた問題の発言は、1948年という歴史的コンテクストに深く根差したものとして再解釈された。比較的近い時期にはじまっているフィッカーと哲学者ハイデガーの思想的接近もこうして、もはやツェランのエピソードと無関係とは見なされなくなる。本稿ではさらに、ツェランによるトラークルの生産的受容の一例として、詩「フランスの思い出」における色彩と音の共感覚的表現を具体的に分析している。

This case study investigates students ’ inquiry-based learning process, by analyzing the relationship between their motivation for learning and learning-support environment. Qualitative methods were used to conduct a case study of one inquiry based learning class of 16 students in a high school with low prestige in Japan. The results showed that 13 students out of 16 (81.3%) enjoyed learning, though they encountered various difficulties in inquiry process. Key factors of developing students'motivation for learning through inquiry based learning are : 1) the subject teacher and the school librarian's flexible and observant responses according to students'difficulties encountered in the inquiry process, 2)supportive friends, families and others, 3) adequate teaching strategies and materials and 4)free and open environment of school library and supportive school culture.

It is said that the privatization of the Japanese National Railway is a success since the management, productivity, and service have improved. However, as expected, the gap of both management and productivity tends to widen between the larger main-island JRs and the smaller three-island JRs. This paper will estimate the cost structure of the six JRs after the privatization. The main points we will make are as follows: first, the economies of scale exist in both the incumbent railway service and the Shinkansen service; second, there is no conclusive evidence to show that the economies of scope exist between them; third, the cost gap between the main-island JRs and the three-island JRs is large; and fourth, the cost gaps within them are also large.
