本稿が検討する婚姻防衛法は、合衆国の連邦法にいう婚姻の定義を「夫と妻としての一人の男性と一人の女性の間の法的結合のみ」に限定することで同姓婚を認める州や国で有効に婚姻した同姓婚夫婦に対し連邦法上の婚姻に伴う利益を否定する効果を持つ法律である。制定当初から合衆国憲法違反の疑いを持たれてきた同法は、2010年以降、複数の連邦裁判所によって第5修正のデュープロセス条項に含まれる平等保護条項に反すると判示されるようになった。婚姻防衛法の正当化根拠である、ⅰ)「責任ある生殖と出産の促進」、ⅱ)「伝統的な異性婚制度の防衛および促進」、ⅲ)「伝統的道徳観念の防衛」、ⅳ)「十分ではない政府資源の保持」のすべてが、婚姻防衛法の効果と合理的にあるいは実質的に関連しないと判断されたためである。本稿は、この婚姻防衛法を違憲とした近時の連邦裁判所の判決から同性婚と異性婚における法的保護の平等について考察し、最終的に、それら判決の中で、婚姻の目的が生殖を含む共同生活から共同生活そのものに変容していると評価されていることを主張するものである。

The purpose of this study was two-fold. The first was to examine job awareness among care managers and how they evaluate .themselves according to the theoretical knowledge and practical skills demanded of them. Secondly we looked at care managers from different backgrounds in terms of qualifications, such as nursing or care workers to see if there was a difference in job awareness and their focus regarding theoretical knowledge and practical skills. This research was based on answers to questionnaires sent 404 care managers who had been trained in Tohoku region. The content and analysis of the questionnaires was the same as that used by Watanabe (2002). As a result of the survey three points became clear. The first was that care managers were aware of need for a high level of technical skill but that the level of understanding on the part of the client was low. Secondly, there were very clear areas of expertise in which care managers were either very confident or, on the other hand, not confident at all. Thirdly, nurses evaluated themselves more highly according to theoretical knowledge and practical skills than care workers did. However, in the areas of interview, client strengths and client serf-determination there were no differences.

"Civilprocedure" (1885), showed to Mr. Kirkwood, said, Hikiainin (_??__??__??_) is a intervener in civil process. I found several judgements of Maebashi-Shishinsaibansho (court of first instance), from 1877 to 1882, now preserved by Maebashi-district court, gave decisions against or in favor of Hikiainin as interveners. This usual practice was not derived from French law, but from the precedent of court in Tokugawa era.This paper analyzes the grounds of the above-mentioned derivation, and explains legal character of Hikiainin in the early Meiji period.

量子コンピュータとは, 量子力学を動作原理とするコンピュータのことである. 現在のコンピュータに比べ, 量子状態の干渉性を用いて計算を高速にでき, 発熱を少なくできるなどの特徴を持ち, 次世代のコンピュータとして期待されている. ナップサック問題とはNP完全に属する問題で, 現在のコンピュータでは効率よく解くアルゴリズムは見つかっていない. 本論文では, 量子コンピュータが高速に計算できる証明とし, ナップサック問題の量子アルゴリズムを述べ, quピットを表現する重ね合わせ状態ができれば, ナップサック問題が多項式時間で解けることを示す.

A daily rest period (DRP; rest taken from daily work during a 24 h period), is essential to work recovery. This study examined DRPs' distribution and association with health outcomes among information technology workers recruited from an internet panel (N=1,811). Participants completed a web questionnaire examining psychological distress as a primary outcome, along with non-restorative sleep, fatigue (stress reaction), and work performance. Logistic regression analysis showed elevated psychological distress when DRP was <12 h (OR: 2.54; 95% CI: 1.47–4.42) and <11 h (OR: 2.48, 95% CI: 1.17–5.26), although the 95% CI included 1 after adjusting for age, sex, and working and commuting hours. After the above adjustment, similar associations were found with non-restorative sleep and fatigue, but not work performance, when DRP was <12 h. These findings constitute the first analysis of a dose-response relationship between DRP and subjective health outcomes among white-collar workers.

Exercise-induced changes in executive function affect the control of action in a dynamic environment. This study aimed to examine the effect of sustained high-intensity exercise on executive function. Nine healthy male and female participants (age, 21-28 years) completed an exercise session with 65-min treadmill running at 75% VO2max. Executive function was assessed before and after exercise with the Stroop Color and Word Test that included congruent and incongruent conditions. The reaction time and response accuracy of the test were measured, and the task difficulty was controlled by adjusting the stimulus duration so that each participant could maintain at least 80% response accuracy to exclude the effect of a speed–accuracy trade-off. The levels of plasma norepinephrine and adrenocorticotropic hormone were examined. A significant interaction with the reaction time was found (condition × time, P = 0.024), in which the reaction time significantly increased after exercise only in the incongruent condition (P = 0.019). The response accuracy was not significantly different between before and after exercise in both conditions, which indicated that the response accuracy was controlled as intended. The levels of plasma norepinephrine and adrenocorticotropic hormone were significantly increased after exercise (P < 0.05). These results demonstrated that the reaction time in the incongruent condition increased after sustained high-intensity exercise with a cognitive function test with the response accuracy controlled, indicating a decline in executive function. Increased levels of plasma norepinephrine and adrenocorticotropic hormone may contribute, at least in part, to such decline in executive function.

事故や災害の発生を防止したり緩和したりするために、様々な安全基準や規約が設けられている。本研究では、そのような各種の事故災害への対応と基準規約の制定に関して、航空・電力・防火・治水・保険・化学・医薬・医療などの工業医療分野において取り上げ、その歴史的過程を分析しようとした。産業社会を支えるそのような巨大な技術システムの基準・規約の全体を取り上げることはできないが、その顕著な側面やよく知られていないが重要な事例などを明らかにした。
