判例研究(Case study)東京高判平成20年5月15日。信号無視の道路交通法違反罪の現行犯人として警察官に現行犯逮捕されたXが、本件現行犯逮捕は違法なものであったとして国家賠償請求をした事例。主に現行犯逮捕における逮捕の必要性が問題となった。

定義 粘膜下層以深に病変の主座を置く隆起により周囲粘膜が引っ張り上げられて,隆起の周囲から隆起表面に向かい,橋が架かるように途絶せずなだらかに移行するひだのことをbridging fold(架橋ひだ)と定義される1).この所見を認めた場合,粘膜下腫瘍(submucosal tumor ; SMT)や非上皮性腫瘍を第一に考える.ただし,癌でも粘膜表層でなく粘膜下層以深に腫瘍塊を形成した場合や,粘膜下層にリンパ組織増生(carcinoma with lymphoid stromaなど),線維化,粘液産生を伴う場合にも同様の所見を呈することがある.

要旨●患者は88歳,男性.主訴は下腹部痛.腹部造影CTにて腸閉塞と診断され入院加療となった.腸閉塞改善後の小腸X線造影検査では終末回腸に腸間膜付着対側を中心とする偏側性変形,偽憩室様変化を,小腸内視鏡検査では縦走から一部輪走する浅い潰瘍,狭小化を認めた.大腸内視鏡検査では盲腸には不整形の浅い潰瘍,回盲弁と上行結腸には輪状潰瘍を認めた.生検による病理組織学的検査,その他の培養,血液検査でも確定診断には至らなかったが,経口摂取後も腸閉塞症状を繰り返していたため回盲部切除術を施行した.病理組織学的所見は粘膜下層に存在する小型から中型の動脈周囲に,多核巨細胞を含む炎症細胞浸潤と肉芽腫様病変を認め,内弾性板の変性や断裂の所見も認められた.頭部症状がなく側頭動脈生検は施行していないが,年齢,赤沈値の亢進,巨細胞性動脈炎(GCA)に特徴的な病理組織像から,腸管に限局したnon-cranial GCAと診断した.GCAの消化管病変の報告は極めてまれであり,その特徴を明らかにするにはさらなる症例の蓄積に基づく検討を要する.

標的型攻撃では,攻撃者が Intrusion Prevention System(IPS)や Intrusion Detection System(IDS),Firewall(FW)などの各種防御技術を回避してネットワークに侵入し,ネットワークをスキャンする.これら防御技術は送信元 IP アドレスや宛先 IP アドレス,スキャンレートなどに基づいてスキャンを検知・遮断し,同一ネットワークへの攻撃拡大を阻止できるが,設定したレート未満である低レートスキャンの検知は難しい.持続的標的型攻撃では,長時間に渡ってネットワークに潜伏することもあり,攻撃者は低レートのスキャンでも攻撃に必要な情報を収集できる.そこで次々にネットワークアドレスを変更し,攻撃者が得られる情報に有効期限を設ける Moving Target Defense(MTD)戦略の利用が検討されている.MTD により,低レートスキャンの防御が実現できるが,アドレス変更間隔の短縮による通信の継続や IPS の通信監視などへの影響が懸念される.本研究では,Software Defined Network (SDN) を利用し,IPS が時間変化する IP アドレスの影響を受けないようにスイッチ上でパケットヘッダを書き換えることで,IPS の動作に悪影響を及ぼさない透過的な MTD を実現する.そして,MTD と IPS を併用するスキャン防御手法を提案する.本手法により,IPS は MTD の影響を受けずにトラフィックを監視できる.さらに,IPS が高レートのスキャンを防御し,MTD が低レートスキャンを妨害することで,様々なレートで行われるスキャンの防御が可能となる.本研究では,コントローラの負荷や,通信遅延やスループットに着目したシミュレーション評価を行った.本実験により,高レートスキャンと低レートスキャンを防御する本手法が,既存手法と同程度の CPU 負荷,通信品質で MTD を実現できることを確認した.

【緒言】呼吸困難に対するフェンタニルの有効性はモルヒネに比してエビデンスが乏しく確立されていない.COVID-19肺炎の呼吸困難に対し,高用量静注フェンタニルから低用量静注モルヒネ投与へのスイッチングが有効であった症例を報告する.【症例】85歳男性.COVID-19肺炎のため気管挿管,人工呼吸管理となり,疼痛緩和のためフェンタニル持続投与が開始された.呼吸困難の訴えが顕著となりフェンタニルを増量したが,効果不十分なため緩和ケアチームが介入し,フェンタニル2400 µg/日からモルヒネ76.8 mg/日に変更したところ呼吸困難は消失した.一方,呼吸抑制が顕著となりモルヒネを10 mg/日まで漸減し,呼吸抑制は改善し呼吸困難も認めなかった.【考察】フェンタニルよりも低用量のモルヒネで呼吸困難を緩和できたのは,フェンタニルの耐性形成や呼吸困難緩和に対するモルヒネの優位性が一因と考えられる.

Les films documentaires qubn considere souvent comme un rassemblement des images directes de la > actuelle, sont aussi caracterises par une particularite diegetique et narrative. Du point de vue semiologique, on peut constater que la stmcture narrative des films documentaires est surtout fondee sur la coincidence apparente (idealement supposee) de la diergese avec le > comme une thematisation (Levinas) du monde dit > . D' ou la position centrale qu'y occupe le cineaste comme > autour duquel s'organise la diegese filmique. Quand cet observateur-temoin devient l'oblet central du film, avec son exploration du passe a travers ses experiences persomelles, le monde intime du cineaste se transforme en un champ d'investigation particuliere. Il devient pour lui une occasion pour se demander sur le statut du reel represente en son rapport avec l'essence qui reste irrepresentable. Ce present article a pour but d'eclaircir le rapport entre le regime narratif et la representation du monde > dans les films documentaires, a partir d'un film experimental du cineaste americain Jonas Mekas. Ce film qui semble recomposer des souvenirs d'un refugie politique a l'occasion de son retour a son pays natal apres 25 ans d'absence, passant par l'histoire de sa vie intime du debut de sa carriere cinematographique, nous offre pourtant un excellent exemple de la reflexion sur le rapport entre la memoire et la representaion dans un film documentaire. Dans ce film, les informations langagieres (narration, titres) qui viennent definir les objets filmes se heurtent a la qualite indefinissable des images, coupees et decoupees pour ne pas laisser determiner et nommer leurs objets. Les efforts pour retrouver l'identite perdue de l'auteur s'avereront aussi inutiles en face de l'irrepresentabilite du passe. Avec ces images dechirees et fragmentees, le cineaste pourtant reussit a nous presenter une vision du monde sans la soumettre a la violence de thematisation. Cette vision reste cependant loin d'eetre une restitution narrative de l'experience. Elle nous fait entrevoir l'existence de ce qui est impossible a representer et de ce fait nous invite a nous interroger sur le droit de regard et de langage cinematographique devant la singularite de l'experience vecue. Car, dans les films documentaires, > est avant tout une necessite ethique.

Zostera marina L. form dense populations on shallow sandy and muddy bottoms in inner bay areas, and play important roles from ecological and fisheries points of view. In this study, photosynthesis characteristics of Z. marina were examined under several light intensity and the water temperature conditions, and the daily net production was estimated. Samples were collected from Miya in Mikawa Bay, Aichi Prefecture, Japan. Photosynthesis and dark respiration rates were measured under various light intensity and in situ temperature condition using a product meter and oxygen electrode system. Z. marina showed high light-saturated net photosynthetic rates(1.5〜7.6mgO_2 gd.w.^<-1> h^<-1>). Dark respiratory rate of Z. marina was between 0.4 and S.SmgO_2 gd.w.^<-1> h^<-1>, I_k values and compensation points ranged from 88 to 129μmol m^<-2> s^<-1> and from 13 to 111 μmol m^<-2> s^<-1>, respectively. Daily net production of Z. marina was estimated from the model equation of photosynthesis-light curve and the data on light intensity sampled in Zostera bed. High dark respiratory rate and low light intensity in the population lead to low net production, and result in withering and loss during the early summer season.

息こらえの学習効果の持続時間を8名の健康成人で測定した.連続して5回息こらえを施行した.毎回の息こらえ前, 5分以上安静状態を保ち, 一定の終末呼気CO2濃度から息こらえを施行した.また, 数日後, 1ヵ月後に同じプロトコールをくり返した.初日, 息こらえ時間は初回, 33.0±10.7秒, 5回目, 51.5±14.4秒であった.数日後, この学習効果は持続し, 初回の息こらえ時間39.1±14.4秒は初日の初回より有意に延長していた.2回目以降の息こらえ時間は初日と同等であった.1ヵ月後, どの回の息こらえ時間も初日と同等であった.息こらえに影響をおよぼしそうな因子 (健康状態, 食事量, 飲酒量, 睡眠時間, 喫煙, 服薬, 運動) はほぼ一定であった.息こらえ自体, および/または, その後の換気亢進が呼吸筋に作用して, その後の息こらえを延長させ, その作用は数日は持続するが1ヵ月は持続しないとの仮説が, 文献的検討からも, 可能と思われた.

好酸球性食道炎は主に食物抗原に対するIgE非依存型(遅延型)アレルギー反応によって好酸球浸潤を主体とする炎症が食道上皮を中心に発生,慢性的に持続し,食道運動障害や食道狭窄をきたす疾患である.元々は小児領域の疾患と考えられていたが,近年,とくに欧米において成人のつかえ感,food impactionの主な原因として注目されている.好酸球浸潤は食道に限局し,好酸球性胃腸炎とは独立した疾患単位として取扱われる.診断は自覚症状と組織学的に有意な好酸球浸潤を証明することが基本となり,内視鏡検査で縦走溝,白色滲出物,輪状溝などの特徴的な所見を認識しつつ,生検を行うことが必要となる.治療においては,原因食物の特定と除去食の有用性が確認されているが,その実施には極めて高度な医学的管理を要するため適応は限定され,薬物治療が主体となる.第一選択はPPI投与,無効な場合はステロイド食道局所(嚥下)治療が推奨されている.本邦では欧米と比較し症状や所見が強い典型例は少ないが,近年のアレルギー疾患の増加とともに今後増加してくる可能性がある.厚生労働省の指定難病としても告示されており,その病態や診断,治療について理解しておく必要がある.

スポーツ中継で表示されるスコアテロップの内容解析は,放送型スポーツ 中継映像の内容解析に有効であると示唆されるが,近年のスコアテロップは,文字やマーク,その背景まで様々な色や輝度が混在し,輝度値だけに 着目して領域内に存在する多種のオブジェクトを背景と区別することは難しい.また,スコアテロップ内の各オブジェクトの表示内容を認識するには,時間経過に伴うオブジェクトの状態変化を調べる必要がある.本稿では,放送型野球中継映像のスコアテロップ領域を対象に,白黒濃淡画像の輝度値に加えRGB濃度値のヒストグラムを用いて領域内に 存在するオブジェクトの外接矩形を抽出し,試合の内容解析に 必要なキーとなる,アウトカウント,得点,ランナーの有無を示す 領域を次フレームでの同一領域との相関を求めて特定する方法を提案する.四つの野球中継映像に対し実験を行った結果,アウトカウントがマーク 表示されている映像を除き,上記の抽出項目はすべて精度良く抽出された.

Il periodo storico, che conclude con L'illuminismo, il crollo di Napolenoe e il subito ritorno della Restaurazione offre un paesaggio letterario assai complicato e dramatizzato. E ben tenere presente questa clima della precedente storia per comprendere precisamente la polemica romantica. Per esempio, Ugo Foscolo, lo scrittore di Ultime lettere di Jacopo Ortis uno degli incunaboli romantici, era in colmo dei sensi nuovi e romantici, ma tenne l'inclinazione verso il classicismo. Non sarebbe esagerante di dire che la posizione di Foscolo si situa Romanticismo e Classicismo. Si direbbe anche lo stesso per quanto alla posizione di Madame de Stael, che e romantica molto conosciuoa, Giordani, compilatore di Biblioteca italiana e classicista. L'ultimo l'esorto di scrivere un articolo alla sua classica rivista Bibliooeca itatiana. L'accordo, sebbene la distinzione precisa d'ideologia, che univa due scrittori sembra lacerare l'atmosfera stagnante di Restaurazione dopo il crollo di Napoleone. In seguito a un articolo della Madame de Stael apparso sul fascicolo di gennaio della Biblioteca italiana la polemica romantica ebbe inizio in Italia. Il Giordani non aveva previsto quali conseguenza gravissima fosse destinato a provocare l'articolo della Stael. Non pensava che dovesse costituiire l'occasione tempestiva per un riesame della cultura italiana, tradizionalmente classicistica e retorica. L'articolo della Stael si presentava come una traduzione sui modi del tradurre, pero allargandosi e congruendosi dei motivi molti e diversi risultava che rimproverava a molti scrittori italiani, specialmente evocava le reazioni clamorosi dei classici a causa l'attacco verso l'imitazione dei classici, Greci e latine. Stael consigliava di fare proprio il piu aperto paesaggio delle moderne letterature europee. I letterati italiani si divisero in romantici e antiromantici o classici. La polemica divenne un fatto di letterature assorbendo in se preoccupazione politiche e spunti sociali, in somma risorgimentale. I rappresentanti dei romantici sono i critici giovani e militanti raccolti attorno al Conciliatore. Ludovico di Breme, il Borsieri e Berchet ecc. Se l'articolo della Stael evocava solo l'anelito di romanticismo il Romanticismo italiano non pareva avere la differenza specifica tra quelli nordichi. In questo punto rientrano le considerazioni sociologiche di Berchet. I principi che Berchet insisteva erano la letteratura popolare e quella subordinata a questo scopo e emanipatasi da ogni regola. In questo modo romanticismo includendo i popoli maggiori di une nazione era non piu la denominazione di una scuola o di un gruppo, ma divenne risorgimentale.

Due to its adversarial relationship with the United States and the Soviet Union, China developed nuclear weapons and ballistic missiles during the 1960s and 1970s in order to have its own deterrent. By the beginning of the 1980s, China had completed a series of liquid-fueled ballistic missiles, in particular the DF-5 ICBM, that covered all of the North American continent.Since then, China has begun to develop a second generation of ballistic missiles; these are powered by solid fuel and and can be moved by road, and so have enhanced responsiveness and survivability. By the end of 1980s, China had developed the JL-1 SLBM and its variant, the DF-21MRBM, although the Xia-class SSBN (Type 092), which was the platform of the JL-1, was unsuccessful and has never been a real strategic asset.<br>China is now attempting to develop the DF-31 ICBM and its variant, the JL-2 SLBM, which will be stable retaliatory forces. The Jin-class new generation SSBN (Type 094), which carries the JL-2, is also under development.<br>As a latecomer to the nuclear club, China resisted joining international non-proliferation regimes, especially the Partial Test Ban Treaty (PTBT) and the Non-Proliferation Treaty (NPT), under which China accused the United States and the Soviet Union of being a" nuclear dictatorship." However, in 1992, after the collapse of the Soviet Union, China joined the NPT and changed its position to support international non-proliferation.<br>In spite of its position, China has continuously exported nuclear technology and ballistic missiles and missile-related materials to Pakistan and other countries. This behavior of China has been regarded by the United States as causing the proliferation of weapons of mass destruction(WMDs).<br>Since late 1980s, the United States has organized a Missile Technology Control Regime(MTCR) with the G8 member countries and legislated domestic laws prohibiting proliferatiig behaviors by other countries. The United States has taken unilateral economic sanctions against countries violating US laws. And since 1991, China has been a main target of these US economic sanctions.<br>In the 1990s, China itself made efforts to legislate its domestic regulations controlling exports relating to WMDs, but since 2001, under the Bush administration, the United States has takensanctions against China as many as 19 times. Hence, it can be said that China's behavior in terms of nuclear proliferation has resulted in a bilateral dispute between the United States and China.

This paper outlines the natures of Habu snake and Erabu sea snake and properties and actions of their venoms. Moreover was described the effect of tannic acid on the venoms.Habu snake (Trimereserus flavoviridis) is venomous, landinhibiting on the Amami islands and about 150cm long. The victims of Habu snake bite was estimated at 250 to 300 each year. The death rate during recent 7 years was more than 1 per cent. The minimal lethal dosis for mice, weighing 15 to 17g. was about 150γ/0.1ml by intramusculare injection. It was considered that the venom was composed of haemorrhagic, angiotoxic and myolytic factors, which were completly inactivated by heating at 100C for 10 minutes, and heat-stable myolytic factor.Erabu sea snake (Laticauda semifasciata) lives on the coast of Amami Oshima, and has strong fatal venoms. Minimal lethal dosis, in experiments with mice weighing 15 between 17g., was about 6γ/0.1ml by the intramusculare injections. Erabu sea snake venom is considered to have chiefly neurotoxic component which was relatively stable in heating.It was recognized that the toxic activities of the venoms of these different species were inhibited by aqueous solution of tannic acid; a 8.5% solution inactivated lethal and local haemorrhagic activities of 500γ/0.1ml of Habu snake venom, and fatal toxicities of 25γ/0.1ml of Erabu sea snake venom.The above mentioned effect of tannic acid on the venoms may be due to coagulations of the venom and tissue proteins by tannic acid.

本論文では,大規模障害を含めた様々な障害を自律的に乗り越えて持続可能な(サステーナブルな)サービスを実現するための基盤ツールキットの設計について述べる.本方式は,多数の計算機を連合させ,それらにサービスの実行とサーバ機能の状態保存を自律的に分担させることでサービスのサステーナブル化を実現する.また,本提案方式は,仮想計算機を用いることで,既存のサービスを容易にサステーナブルにすることを可能にしている.In this paper, we describe our design of an infrastructure toolkit for realizing sustainable services, which can surmount various kinds of failures, including catastrophe. Our system consists of many federating computers. It enables the service to be sustained by making some of the computers run server functions, and the others share storing states of the service. And also our method is designed to be applicable for existing services by using virtual machines.

Objective: There have been reports of health hazards caused by medical devices, cosmetics, quasi-drugs, daily necessities, hygiene products, etc. (health-related products) sold in pharmacies and drugstores. However, the role pharmacists play in dealing with the health hazards caused by health-related products has not been clarified. Therefore, we conducted a survey on the cases of health hazards related to health-related products and the views of pharmacists.Methods: A questionnaire was administered anonymously by email to 601 pharmacists working in community pharmacies or drugstores between December 11 and 20, 2019.Results: The number of valid responses was 585. The breakdown of health hazard cases where pharmacists counseled customers were 60 for medical devices, 31 for cosmetics, 18 for quasi-drugs, 9 for hygiene products, and 20 for daily necessities and others. Of those 138 cases, 19 cases of medical devices were estimated to have an intermediate risk as a health hazard, and the other 119 cases were all classified as low. Of the cases that the pharmacists were not approached for help, but were aware of, 57 were medical devices (21 high, 31 intermediate, 5 low), 44 were cosmetics (12 intermediate, 32 low), 12 were quasi-drugs (7 intermediate, 5 low), 7 were hygiene products (7 low), and 64 were daily necessities and others (26 high, 34 intermediate, 4 low). With regard to health-related products, 95% of the respondents indicated that they had responded to customer questions with advice.Conclusion: Our results show that there are various cases that could develop into health hazards due to health-related products, and most respondents felt a need to alert the public. As such, pharmacists and other staffs in drugstores will continue to provide health support functions to their customers by advising them on not only pharmaceuticals but also these health-related products.
